This book analyzes the implementation of peace processes in Northern Ireland and Guatemala, with emphasis on the role of mid-level civil society and religious organizations, or "the voluntary sector." Despite very different economic development levels, both countries have colonial legacies, deep cultural divisions, and engaged diaspora. One of the longest and seemingly most intractable civil wars in Latin America was brought to an end by the signing of the Peace Accords between the Guatemalan government and the Unidad Revolucionaria Nacional Guatemalteca (URNG) in December 1996. The essays in this volume evaluate progress made in the implementation of the peace agreements and signal some of the key challenges for future political and institutional reform. The volume opens with a chapter by Gustavo Porras, the government's main negotiator in the peace process. The first section then examines the issue of demilitarization. This is followed by aspects of indigenous rights in the peace process, including conceptual frameworks for rights advancement, the harmonization of state law and customary law, and the challenges of nation-state and citizenship construction. The next section examines issues of truth, justice, and reconciliation, and assesses prospects for the Truth Commission. On February 13, 1982, the Guatemalan army stormed into the remote northern Guatemalan village of Santa Maria Tzeja. The villagers had already fled in terror, but over the next six days seventeen of them, mostly women and children, were caught and massacred, animals were slaughtered, and the entire village was burned to the ground. Twelve years later, utilizing terms of refugee agreements reached in 1982, villagers from Santa Maria who had fled to Mexico returned to their homes and lands to re-create their community with those who had stayed in Guatemala. Return of Guatemala's Refugees tells the story of that process. In this moving and provocative book, Clark Taylor describes the experiences of the survivors -- both those who stayed behind in conditions of savage repression and those who fled to Mexico where they learned to organize and defend their rights. Their struggle to rebuild is set in the wider drama of efforts by grassroots groups to pressure the government, economic elites, and army to fulfill peace accords signed in December of 1996. Focusing on the village of Santa Maria Tzeja, Taylor defines the challenges that faced returning refugees and their community. How did the opposing subcultures of fear (generated among those who stayed in Guatemala) and of education and human rights (experienced by those who took refuge in Mexico) coexist? Would the flood of international money sent to settle the refugees and fulfill the peace accords serve to promote participatory development or new forms of social control? After years of virtual civil wars, insurgents in El Salvador (1992) and Guatemala (1996) signed Peace Accords with their governments. This thesis examines the peace processes in El Salvador and Guatemala and focuses on the establishment of the rule of law after years of civil war as a precondition for democratic consolidation. The issue areas investigated are: the redefinition of the role of the armed forces in the state; the demilitarization of the police forces; judicial reform; and how these states deal with past human rights violations which have occurred during the wars, with particular emphasis on the issue of impunity. The thesis argues-that while significant progress has been made in establishing the rule of law since the signing of the Peace Accords, there are still areas of concern which may forestall democratic consolidation. The primary mission of the militaries of both countries has been shifted to external defense. Civilian police forces have been established and they have been removed from military control. Despite these facts, the military is still playing a limited internal policing role in support of the police forces. Judicial reform has progressed in both countries but this area is still in need of more attention and funding. Human rights abuses and the issue of impunity have received much attention in both countries, but the passage of amnesty laws in both countries, which prevent the prosecution of those who committed human rights abuses during the civil wars, has perpetuated a sense of military and governmental impunity.
