Revolusi industri 4.0 telah mengakibatkan disrupsi yang memengaruhi berbagai-sendi kehidupan terutama yang terkait dengan perkembangan ekonomi digital dan ekonomi kreatif pada umumnya. Berdasarkan kenyataan inilah penulis setelah mengkaji secara mendalam dari berbagai sisi, mengemukakan teori baru terkait keberadaan hak cipta sebagai jaminan kredit perbankan dan urat nadi ekonomi kreatif dan ekonomi digital. Teori ini penulis namakan: Teori Superioritas Hak Cipta dalam Disrupsi Digital. Teori ini dilandasi pilar sebagai berikut: Pertama, hak cipta adalah kekuatan untuk dapat bersaing secara kompetitif pada era revolusi industri 4.0. Kedua, hak cipta merupakan alat yang justru dapat mendisrupsi model-model bisnis konvensional. Ketiga, melalui hak cipta, negara dapat terus mengembangkan ekonomi kreatif dan ekonomi digital. Oleh karena itu, jika negara tidak ingin tertinggal menghadapi industri 4.0 maka harus dilakukan 2 (dua) hal yaitu mendorong inovasi di bidang hak cipta yang dapat diaplikasikan dalam industri dan negara secara konsisten melindungi hak cipta secara hukum dan ekonomi. Keempat, dengan kenyataan disrupsi digital dan kekuatan hak cipta sebagai alat disrupsi maka perlu dipahami bahwa hak cipta memiliki nilai ekonomi yang sangat tinggi bahkan dalam beberapa hal dapat melebihi nilai property seperti tanah, bangunan dan asset lainnya. Berdasarkan hal-hal tersebut maka dapat dikemukakan, bahwa sangat layak dan sangat potensial hak cipta dapat dijadikan jaminan bukan hanya kredit perbankan atau pembiayaan perusahaan lainnya, tetapi juga menjadi salah satu bentuk kepercayaan performance dan kredibilitas sebuah perusahaan. Dalam rangka melaksanakan hal ini, diperlukan adanya jasa copy rights apprissal sebagai lembaga yang menilai valuasi dan kelayakan hak cipta sebagai jaminan.

Hak Kekayaan Intelektual (HKI) adalah aset berharga yang dapat dikembangkan menjadi bisnis waralaba, bisnis kreatif, bisnis digital dan bisnis tekfin.
