Waren- und Dienstleistungsströme sind in der heutigen Zeit in der Regel global, so dass die Exportwirtschaft fortlaufend mit der Herausforderung konfrontiert ist, in vollkommen unterschiedlichen rechtlichen Umfeldern tätig werden zu müssen. Bekannt ist auch bereits lange, dass unterschiedliche Vorschriften über den Marktzugang und die Behandlung ausländischer Waren auf heimischen Märkten hierbei ernst zu nehmende Probleme verursachen können. Die Problematik ist aber insbesondere in den letzten Jahrzehnten immer drängender geworden. Die am 15. April 1994 gegründete Welthandelsorganisation (WTO - Word Trade Organization) verkörpert vor diesem Hintergrund wie keine andere internationale Organisation den Versuch, internationale Regeln für den grenzüberschreitenden Handelsverkehr zu schaffen und durchzusetzen, die den globalen Handel mit seinen Risiken in berechenbare Bahnen lenken sollen. Heute wird ca. 97 % des weltweiten Handels mit Waren und Dienstleistungen zwischen den Mitgliedsstaaten der WTO abgewickelt. Die Kenntnis des WTO-Rechts ist deshalb gerade im Exportgeschäft von höchster Bedeutung. Aufgrund der Tatsache, dass nahezu alle wichtigen Handelsnationen der Welt Mitglieder in der WTO sind (derzeit hat die WTO 153 Mitgliedsstaaten) hat die WTO (und damit das WTO-Recht) heute eine überragende Bedeutung für den internationalen Handelsverkehr und deshalb auch für den Export. Die vorliegende Arbeit versucht einen Überblick über die Grundprinzipien und -regelungen des Rechts der Welthandelsorganisation (WTO) und des Allgemeinen Zoll- und Handelsabkommens (GATT), des Allgemeinen Übereinkommens über den Handel mit Dienstleistungen (GATS), des Übereinkommens über handelsbezogene Aspekte der Rechte des geistigen

The Doha Round is the first major trade negotiation round under the WTO since the failure of the Seattle Ministerial in 1999. The Doha discussions and results will have a large impact on the future of international trade law. Leading scholars and practitioners from three continents comment on four such areas in this book. Firstly, poverty eradication, capacity building, and special and differential treatment are required to change for WTO law to be accepted globally; this may lead to a reinterpretation of WTO law. Secondly, the major trade policy concerns, the global concept of competition, and the impacts of trade facilitation and of sustainability of trade liberalization are examined. The third topic is the improvement of the dispute settlement through, for example, a relaxation of tensions between the judicial and diplomatic models. Technical standards are increasingly determining the development, production, trade in and marketing of goods and services. In order to ensure that technical regulations and product standards which vary from country to country do not create unnecessary obstacles to trade the Agreement on Technical Barriers to Trade was adopted during the Uruguay Round. It is paralleled by the Agreement on Sanitary and Phytosanitary Measures which sets out the basic rules on how governments can apply food safety as well as animal and plant health measures without, however, using them as an excuse for protecting domestic producers. Prominent decisions under the WTO Dispute Settlement have interpreted those provisions. This volume gives a detailed account of the necessary parameters for technical standards and measures seeking to protect health and environment. Included are commentaries on Articles III, XI and XX of GATT 1994 which are equally relevant in this context. The article by article commentaries draw from a considerable body of case law, the work by the TBT and SPS Committee and the relevant legal literature. Many product markets have gone global already. Others are following. The globalization of markets is well understood by business. It has also come to dominate the economic policy agenda of nation states and supranational organizations. They all compete for inward investment to create and preserve employment opportunities. Economic law is one of several parameters in the global competition of systems. This study takes note of that new and additional function of economic law. Part I sets out to examine the making of economic law by states, by business and by international and supranational organizations. Part II discusses some of the main rules of substantive economic law divided into chapters on market law, transactions law and property rights law, and Part III addresses key issues of enforcement by the executive branch, on the one hand, and by the judiciary and arbitral tribunals, on the other. Each of the 32 chapters contains an essay on a current cross-border related problem of economic law, often as reflected in recent case law. Nearly 300 cases are discussed, or at least referred to, in that way. They were selected from international case law and from cases decided by EC, US and German courts (and courts of ten more countries) as well as by ICC, ICSID and other arbitral tribunals. The introductory notes to, and summaries of, the various parts and chapters integrate economic and political theory, and provide the common thread. The overall conclusion is to advocate a transnational approach, problem oriented and cutting right across all layers of sources of law (international, supranational, national and transnational law). It distinguishes neatly between public and private law aspects of economic law but decidedly treats them together.
