Die Konferenzen der Vertragsstaaten der UN-Klimarahmenkonvention werden mittlerweile durch Diskussionen über die Platzierung von Systemen international handelbarer Umweltrechte und Minderungsnachweise ("Kyoto- Mechanismen") bestimmt. Von der Europäischen Kommission kam im März 2000 der Anstoß zur Einrichtung eines gemeinschaftsinternen Emissionshandelssystems ab dem Jahr 2005 vor. Dänemark praktiziert ein solches System bereits seit 2001. Initiativen für den Setup derartige Regelungen, gibt es in zahlreichen anderen internationalen Staaten. Hinzu kommen Zertifikatessysteme, die einzelne Unternehmen intern zur Umsetzung von freiwilligen Selbstverpflichtungen aufbauen oder bereits betreiben. Es bilden sich derzeit bereits in vereinzelten Ansätzen Märkte für den länderübergreifenden Handel grüner Zertifikate heraus. An anwendungsreifen Vorschlägen zum Einsatz von Zertifikaten mangelt es nicht. In der Literatur bereits diskutiert wurden u.a. Zertifikate zur Reduzierung von Globalschadstoffen wie Kohlendioxid oder Abfall-Zertifikate und Abfüll-Zertifikate für Einwegflaschen. Trotzdem konnten in der umweltpolitischen Praxis lediglich in den USA umfangreiche Erfahrungen mit Zertifikaten gesammelt werden, wo diese vornehmlich in der Luftreinhaltepolitik eingesetzt werden. In Deutschland wurden seitens der Politik noch keine dem theoretischen Konzept entsprechenden Vorschläge zur Einführung von Zertifikaten gemacht. Aus diesem Blickwinkel heraus hat sich in

Im Fokus umweltpolitischer Bemühungen steht vor allem der Schutz von Umweltgütern mit einer weltweiten räumlichen Ausdehnung. An diesen Gedanken anlehnend kann der Klimaschutz zur zentralen umweltpolitischen Aufgabe der Gegenwart und Zukunft erklärt werden. Über die ökonomische und ökologische Effizienz der handelbaren Umweltzertifikate wurde, seit J. H. Dales 1968 dieses Instrument entdeckte, kontrovers und ausführlich diskutiert. An das Konzept werden große Erwartungen zur Lösbarkeit bzw. zur Linderung globaler Umweltprobleme gestellt. In der Theorie gelten Umweltzertifikate als geeignetes Instrument der Regulierung weiträumig wirkender Schadstoffe. Trotzdem werden Umweltzertifikate in der Praxis bisher kaum angewendet und sind in den vergangenen Jahren ins Kreuzfeuer der öffentlichen Debatte geraten. Die vorliegende Arbeit soll einerseits einen Überblick über das Konzept und die Anwendung von Umweltzertifikaten ermöglichen. Anderseits soll eine Antwort auf die zentrale Fragestellung gefunden werden, ob international handelbare Umweltzertifikate zur Lösbarkeit globaler Umweltprobleme erfolgreich einsetzbar sind. Dazu werden im theoretischen Teil verschiedene Aspekte dieses umweltpolitischen Instrumentes untersucht und eine definitorische Abgrenzung vorgenommen. Eine Beurteilung findet anhand der Kriterien: ökologische Treffsicherheit, ökonomische Effizienz sowie dynamische Anreizwirkung statt. Im anschließenden Teil der Ausführungen wird die Ausgestaltung eines internationalen Zertifikatesystems diskutiert. Dazu findet eine kurze Darstellung der praktischen Erfahrungen mit Umweltzertifikaten in den USA statt. Durch die Betrachtung der Ergebnisse des Kyoto-Protokolls und der geplanten Etablierung eines europäischen Zertifikatemarktes werden aktuelle Tendenzen und Entwicklungen im Emissionshandel aufgezeigt. Probleme werden erörtert und kritisch gewürdigt.
