Everyone would agree that urban development, especially when involving the building of residential areas, should be accompanied by sufficient and good public infrastructure and facilities. We all want neighbourhoods with the necessary roads, green areas, social facilities, affordable housing and public spaces of high quality. At the same time, nowadays, governments are facing severe cuts in public expenditure. So who is going to pay for all that quality? In the Netherlands and in many other countries, achieving these public goals has become a problem, especially in the regeneration of deteriorated inner-city sites. This book offers insight in how the economic value increase that arises from urban development can serve to finance the quality we want, without the need for public subsidies. Met de inwerkingtreding op 1 juli 2008 van de Wro is het instrumentarium voor de toepassing van kostenverhaal ingrijpend gewijzigd. Tevens is op dat moment, voor het eerst, een publiekrechtelijk instrumentarium beschikbaar gekomen voor het door het ruimtelijk bevoegd gezag kunnen stellen van publiekrechtelijke eisen aan de uitvoering van ruimtelijke plannen (de zogenaamde 'locatie-eisen'). De parlementaire behandeling van het wetsvoorstel Grondexploitatiewet kende interessante debatten over de doelstelling maar ook over de op dat moment te verwachten (rechts)gevolgen van het nieuwe instrumentarium. Soms leidde dat tot verduidelijking, maar diverse vragen voor de uitvoeringspraktijk bleven. In de periode rondom de invoering van de nieuwe Wro zijn diverse boeken en bijdragen in tijdschriften verschenen over de doelstellingen en uitleg van de nieuwe wettelijke regels. Vanaf 1 juli 2008 deden gemeente (en soms ook provincie en rijk) en particuliere exploitant (de professionele ontwikkelaar maar ook de individuele bouwer) ervaring op met de nieuwe regels. Er ontstonden (anterieure) overeenkomsten maar ook exploitatieplannen. Nu, zo’n drie en een halfjaar na de invoering van de Wro, overstijgt het aantal exploitatieplannen (of anders gezegd: de publiekrechtelijke kostenverhaalsbesluiten) ruimschoots het aantal baatbelastingtoepassingen in de grondexploitatie onder de WRO. Daarmee is, vergeleken met de situatie onder de WRO, sprake van een toename van de toepassing van publiekrechtelijk kostenverhaal. De omvang van het aantal exploitatieplannen heeft ook geleid tot diverse beroepsprocedures bij met name de Afdeling bestuursrechtspraak van de Raad van State. Na 3,5 jaar is sprake van een omvangrijke hoeveelheid jurisprudentie, waarin de (eerste) lijnen en trends zichtbaar beginnen te worden. Er is inmiddels alle aanleiding voor een uitgave met een artikelsgewijs commentaar van de bepalingen uit de Wro en het Bro over de afdeling Grondexploitatie. Dit boek geeft een zo volledig mogelijk beeld van de wettelijke regeling, de parlementaire geschiedenis en de inmiddels gevormde jurisprudentie, dit alles voorzien van deskundig commentaar. De doelstelling is niet alleen het verstrekken van een overzicht van de wetsartikelen afzonderlijk, maar ook het inzichtelijk maken van de relaties tussen de verschillende wetsbepalingen. De auteurs hebben jarenlange ervaring in deze rechtspraktijk, zij geven onderwijs en publiceren regelmatig over deze onderwerpen. Dit artikelsgewijs commentaar is een onmisbare hulp voor iedereen die te maken heeft met ruimtelijke ordening en gebiedsontwikkeling.
