Das kurze Leben des streitbaren Rechtsanwalts Hans Litten, der 1938 im KZ Dachau in den Selbstmord getrieben wurde. In einem spektakulären Prozess vor dem Berliner Kriminalgericht in Moabit stellte der junge Rechtsanwalt Hans Litten 1931 den »Schriftsteller« Adolf Hitler als Zeugen für die Gewaltbereitschaft von SA und NSDAP zur Rede. Litten verteidigte in zahlreichen Prozessen straffällige Jugendliche, trat als Nebenkläger für die von faschistischen Rollkommandos attackierten Kommunisten auf und legte sich mit der rechtslastigen Justiz der Weimarer Republik an. Seine Biografie ist eine deutsche Lebensgeschichte, die mit der jüdischen Jugendbewegung in Ostpreußen begann und im Konzentrationslager Dachau endete. Im geteilten Deutschland wurde sie in unterschiedlichen Versionen überliefert. Die einen würdigten den antifaschistischen Bündnispartner der Arbeiterklasse, die anderen – mit jahrzehntelanger Verspätung – den Verteidiger des republikanischen Rechtswesens. Heute ist Hans Litten – nicht zuletzt durch die TV-Serie »Babylon Berlin« – weit über Deutschland hinaus als politischer Anwalt bekannt, der sich kompromisslos und mutig für seine Mandanten eingesetzt hat.

George L. Mosse (1918-99) was one of the most influential cultural and intellectual historians of modern Europe. A refugee from Nazi Germany, he was an early leader in the study of fascism and the history of sexuality and masculinity, authoring more than two dozen books. In ContemporaryEurope in the Historical Imagination, an international assembly of leading scholars explore Mosse's enduring methodologies in German studies and modern European cultural history. Considering Mosse's life and work historically and critically, the book begins with his intellectual biography and goes on to reread his writings in light of historical developments since his death, and to use, extend, and contend with Mosse's legacy in new contexts he may not have addressed or even foreseen. The volume wrestles with intertwined questions that continue to emerge from Mosse's pioneering research, including: What role do sexual and racial stereotypes play in European political culture before and after 1945? How are gender and Nazi violence bound together? And what does commemoration reveal about national culture? During a 1931 trial of four Nazi stormtroopers, known as the Eden Dance Palace trial, Hans Litten grilled Hitler in a brilliant and merciless three-hour cross-examination, forcing him into multiple contradictions and evasions and finally reducing him to helpless and humiliating rage (the transcription of Hitler's full testimony is included.) Courtroom to Revolutionary Stage challenges the orthodox interpretation of Weimar political justice. Henning Grunwald argues that an exclusive focus on reactionary judges and a preoccupation with number-crunching verdicts has obscured precisely that aspect of trials most fascinating to contemporary observers: their drama. Drawing on untapped sources and material previously inaccessible in English, Grunwald shows how an innovative group of party lawyers transformed dry legal proceedings into spectacular ideological clashes. Supported by powerful party legal offices (which have hitherto escaped scholarly notice almost entirely), they developed a sophisticated repertoire of techniques at the intersection of criminal law, politics, and public relations. Harnessing the emotional appeal of tens of thousands of trials, Communists and (emulating them) National Socialists institutionalized party legal aid in order to build their ideological communities. Defendants turned into martyrs, trials into performances of ideological self-sacrifice, and the courtroom into 'revolutionary stage', as one prominent party lawyer put it. It is this political justice as 'revolutionary stage' that most powerfully impacted Weimar political culture. While it helps to explain Weimar's demise, this argument about the theatricality of justice transcends interwar Germany. Trials were compelling not because they offered instruction about the revolutionary struggle, but because in a sense they were the revolutionary struggle. The ideological struggle, their message ran, left no room for fairness, no possibility of a 'neutral platform': justice was unattainable until the Republic was destroyed.

Es folgt eine Darstellung zu Kammer und Oberlandesgericht Hamm im Wandel der Zeit sowie zu den berufsrechtlichen und wirtschaftlichen Problemen der Anwaltschaft, insbesondere in und nach dem Ersten Weltkrieg. Den Abschluss bildet die Darstellung der Debatten über die Zulassung von Frauen zu den Rechtspflegeberufen Das zweite Kapitel schildert, wie unter der NS-Diktatur auch die verfasste Anwaltschaft von der Umwälzung des gesamten Staatsapparates erfasst wurde, beginnend mit der Auflösung der Kammervorstände und endend mit der zunächst faktischen, dann auch rechtlichen Abschaffung des Kammerwesens. Im dritten Kapitel geht es um die wirtschaftliche und berufsrechtliche Lage der Anwaltschaft in der Zeit von 1945 bis 1949 in der britischen Besatzungszone, beginnend mit der Wiedererrichtung der Rechtsanwaltskammer Hamm im Jahre 1945; es schildert die teilweise katastrophalen Arbeitsbedingungen in Anwaltschaft und Justiz und befasst sich mit anwaltlichen Sonderproblemen dieser Zeit.
