The 2015 Parliament will see the continuing development of the relationship between Scotland and the United Kingdom as a whole. The Scotland Bill currently going through the House of Commons will devolve to the Scottish Parliament substantial powers over taxation and welfare, increasing both its powers and its responsibilities. Underpinning this transfer of responsibilities will be a revised fiscal and funding framework for Scotland-a crucial part of the devolution process that will give the Scottish Government and Parliament greater financial autonomy and substantially increase their accountability to the people of Scotland. Like other departmental select committees, the Scottish Affairs Commitee is charged with scrutinising the performance of a government department, in its case, the Scotland Office, the "guardian of the devolution settlement" and its relations with the Scottish Parliament. Through this inquiry the Scottish Affair Committee wishes to find out directly from people and organisations in Scotland what key issues we should be looking at in the first part of this Parliament.

The Scottish Affairs Committee has published a report calling for reform to visa rules for non-EU students studying in Scotland who wish to remain in the UK to work after their studies. In their report the Committee have found that current rules for students studying here to remain in Scotland are too restrictive and are preventing businesses from finding skilled workers. Scotland faces different demographic challenges to the rest of the UK, with a much lower birth rate and significant skills gaps in the workforce. Sectors, such as health, energy and finance face particular problems in recruiting skilled graduate workers. The Committee found that the closure of the Tier 1 (Post-Study Work) visa in 2012, has harmed Scotland by making Scotland less competitive in the global education market, with other nations able to offer prospective students greater employment opportunities after graduation. Closing this visa has also prevented Scotland from making use of a pool of skilled workers, educated in Scotland, who could help mitigate Scotland's demographic challenges. Since the Post-Study Work visa was closed in 2012 the number of non-EU students remaining in the UK after graduating has fallen by 80%.

Scotland's creative industries are an international success story, having produced some of the world's best creative talent and some of the world's best-selling creative content. Scotland also hosts the world's largest arts festival, the Edinburgh Festival Fringe, which brings together performers and audiences from across Scotland, the UK and the world. The creative industries in Scotland have been tremendously successful, and they will no doubt continue to be so. For the potential of these industries to be maximised, however, it is essential that industry views are taken into account by both the UK and Scottish governments in order to create the right policy framework for supporting creative enterprises and benefitting the Scottish economy and Scotland's reputation as a centre of creative talent. Scottish Parliament's Economy, Energy and Tourism Committee recently held an inquiry into the economic impact of the creative industries in Scotland, looking at the film, TV and video games industries, and produced a report in March 2015. Their work focused on devolved areas of responsibility but also considered the impact of reserved matters such as tax reliefs, immigration and broadcasting. The Scottish Government responded to the report in May 2015, accepting a number of their recommendations and committing to take action on them. We launched our inquiry into the creative industries in Scotland to focus on some of the reserved policy areas highlighted by the Scottish Parliament's Economy, Energy and Tourism Committee and to look at how the interests of the creative industries in Scotland are represented at a UK-level.

The Scottish Affairs Committee calls for the repeal of the Bedroom Tax. While this is being considered, the Committee calls on the Government to suspend application of the Bedroom Tax for all those tenants to whom a reasonable alternative offer cannot be made. There are not enough smaller houses available for tenants to transfer into. The lack of any alternative offers means that tenants have no choice but to go into arrears if they simply cannot afford the extra costs. Other amendments proposed for the operation of the tax include: exemptions for those disabled people who require a room to store or use equipment or aids; non application where it would be financially perverse to do so - eg where removing fixed aids and adaptations, and then reinstalling them in a smaller home, would be more expensive than the savings over two years; all children of secondary school age should be allowed a bedroom of their own to allow quiet study; all disabled children, of whatever age, should have a bedroom of their own. The Committee also calls for changes to the system of Discretionary Housing Payments, which have been designed by the Government to mitigate the worst impacts of the Bedroom Tax. There should be a standard nationwide entitlement system, across the UK as a whole, rather than the present postcode lottery. The UK and Scottish Governments should make longer term commitments to the provision of DHP payments in order to allow local authorities to plan and structure their budgets.

The Government has set itself the challenging target of halving the number of children living in poverty by 2010-11 and eradicating child poverty by 2020. With 2010 fast approaching, Ministers are still committed to the targets, and the Committee wanted to ascertain whether DWP has the right measures in place to meet its objectives. Significant progress has been made, but the target remains challenging: there are still 2.8 million children living in poverty and the most recent data shows a slight increase in this number. The Committee is convinced of the damaging effect of poverty on a child's self-esteem and expectations, and also its effects in contributing to social exclusion. Children growing up in poverty are also more likely to have poorer health and poorer educational outcomes. There are groups of children who have a much higher risk of growing up in poverty, for example if they or a parent are disabled, and there are higher poverty rates amongst Pakistani, Bangladeshi and black children. Getting parents into sustainable work should be the focus of the strategy to lift them and their children out of poverty, but there are concerns that the Jobseekers' Allowance regime is not sufficiently flexible to reflect the complexity of lone parents' lives. To eradicate child poverty by 2020, the Government needs a long-term strategy on benefit income for those who are unable to work. If benefits are uprated in line with inflation, the gap between the incomes of those in work and those on benefits will only get wider, as benefits will not keep pace with earnings. As poverty is measured as a percentage of median earnings, the implications for the 2020 target, in particular, are serious.

Zero hours contracts and other forms of casual labour can benefit workers and employers in Scotland but the Scottish Affairs Committee's inquiry has shown that, too often, the relationship is unbalanced, leaving the employer with all of the flexibility and few costs and the worker in fear of dismissal, denied access to due rights of employment and, in some cases, earning less than the minimum wage. The Government recognises that poor practice exists and needs to be addressed but the UK Government's consultation on zero hours contracts was too narrow. The Government must do more to protect workers who wish to challenge unfair, unsafe or unlawful conditions of employment. Workers should be told from the outset of their employment what type of contract they are on and a written contract setting out the terms and conditions must follow within two months. There should be a minimum notice period of work and workers should not be punished for turning down offers of work made within that period. Where workers arrive for work but find none available then the employer should compensate them for the inconvenience. Travel time between appointments should be paid and pay for zero hours workers should accurately reflect the number of hours that are worked to fulfil contracted duties. The recommendations will improve the working conditions of people on zero hours contracts but the Committee's overriding conclusion is that, in the majority of cases, zero hours contracts need not and should not be used at all.
