„...zu wolverdienter straff, und anderen zum abscheulichen Exempel mit dem Feuer vom leben zum tod hinzurichten und zu bestraffen...“ lautete üblicherweise der Tenor, wenn eine sogenannte „Hexe“ aufgrund der ihr vorgeworfenen Zaubereihandlungen schuldig gesprochen wurde. Mit solchen Delikten hatte sich die Gießener Juristenfakultät im Rahmen ihrer Spruchtätigkeit u. a. zu beschäftigen, wenn sich ratsuchende Stellen - in der Regel Gerichte - während eines Hexenprozesses über den Fortgang oder die Beendigung eines solchen informieren wollten. Diese Studie untersucht die in diesem Zusammenhang entstandenen Entscheidungen. Es handelt sich um einfache Rechtsbelehrungen, Gutachten und Urteile, die die Fakultätsmitglieder der Ludoviciana im 17. und beginnenden 18. Jahrhundert als rechtsberatende Institution in Hexenprozessen zu fällen hatten. Dabei wird zum Einen das Augenmerk auf den formellen Ablauf der Spruchtätigkeit in Hexensachen gelegt, zum Anderen der Gegenstand der Sprüche näher beleuchtet. Die Möglichkeit der Hexerei wurde von den Gießener Juristen nicht angezweifelt. Die Studie zeigt aber, dass sie sich bei der Beantwortung der an sie gerichteten Fragen an einem strafrechtlichen System orientierten, so dass der Vorwurf der Willkür bei der Entscheidungsfindung in Hexensachen in nahezu allen Fällen keinen Halt findet. Dies gilt sowohl für die Fragen nach der Rechtmäßigkeit einer bevorstehenden Folteranwendung als auch nach der auszusprechenden Todesstrafe, die in der Regel auf Verbrennen zu lauten hatte. “… as well-deserved punishment, and as a detestable example to others, to be condemned and punished to death from life through fire …” was the usual tenor when a so-called ‘witch’ was pronounced guilty on the grounds of the magical acts of which she had been accused. The faculty of law at Giessen University had to deal with such crimes in its role as provider of legal opinions, when bodies seeking advice – usually local courts – required information during a witchcraft trial as to how such a case should progress and end. This study examines the decisions recorded in this context: charges, reports and judgments made by the faculty members of the Ludoviciana in the 17th and early 18th centuries in their capacity as legal advisors in witch-trials. Attention is given to the formal procedure of providing opinions in cases of witchcraft, and the content of the judgements is also examined more closely. The legal experts of Giessen did not doubt the possibility of witchcraft. However, this study shows that they were guided in answering the questions directed to them by a criminal law system, so that in almost every case the accusation of arbitrary decisions in questions of witchcraft cannot be borne out. This is true both for questions regarding the legality of a planned use of torture and for the punishment to be pronounced after a death sentence, which usually had to be burning.

From the early modern age until the 19th century, the Spruchtätigkeit of law faculties in the German-speaking countries – i.e. the rendering by academic jurists of legal opinions on submitted cases – significantly influenced not only the actual work of faculty members but also the legal reality of the Holy Roman Empire. The faculty of law at Giessen was an important player in the system of early modern Aktenversendung and was applied to by lawyers from almost all the territories of the Empire. This study not only sheds light on the legal foundations of Spruchtätigkeit at the University of Giessen in imperial and territorial legislation, but for the first time undertakes a through analysis of the content of the documents. There is an emphasis on material and natural law. The study combines the examination of university and territorial foundations with a comprehensive analysis of the content of the documents that survive today.

Der Historiker Johannes Haller (1865–1947) und der Leipziger Thomaskantor Karl Straube (1873–1950) zählen auf unterschiedlichem Terrain zu den einflussreichsten deutschen Intellektuellen in der ersten Hälfte des 20. Jahrhunderts. Während Hallers mehrbändiges Werk "Das Papsttum. Idee und Wirklichkeit" bis heute als grandiose Darstellungsleistung gilt, hatte Straube maßgeblichen Anteil am Aufschwung der Kirchenmusik im ersten Drittel des 20. Jahrhunderts. Insofern ist es ein Glücksfall, dass aus der langjährigen Korrespondenz der beiden freundschaftlich verbundenen Persönlichkeiten ca. 60 Briefe erhalten blieben, die entweder, wie im Falle der Briefe Hallers, gänzlich unbekannt waren oder noch nicht publiziert worden sind. Sie werden nun in einer reich kommentierten und mit einer kenntnisreichen Einleitung versehenen Edition der interessierten Öffentlichkeit zugänglich gemacht. In der Korrespondenz geht es um Privates und Berufliches, etwa um die Musik, die beiden am Herzen lag, oder um die Arbeiten des Historikers, aber auch um klassische Literatur und Neuheiten auf dem Buchmarkt. Die Tagespolitik schwingt dabei stets im Hintergrund mit. Was speziell Haller über die militärische Situation und die Zukunft Deutschlands gegen Ende des Zweiten Weltkriegs äußert, ist wirklichkeitsfremd und beklemmend zugleich. Da die beiden Freunde die Kunst des Briefeschreibens in vollendeter Weise beherrschen, ist diese Edition neben ihrer kulturgeschichtlichen Bedeutung auch stilistisch ein Genuss. The historian Johannes Haller (1865–1947) and the Cantor of St Thomas’s church in Leipzig Karl Straube (1873–1950) are in their different spheres among the most influential German intellectuals of the first half of the 20th century. While Haller’s multi-volume work on the Papacy, „Das Papsttum. Idee und Wirklichkeit“ is still valued today as a grandiose achievement, Straube played a significant role in the revival of church music in the first third of the 20th century. It is therefore a fortunate chance that some 60 letters survive from the long correspondence between the two friends; some, as in the case of Haller’s letters were completely unknown, while others have never been published. Now they have been made available to an interested audience in a richly annotated edition with a well-informed introduction. The correspondence concerns both private and professional life; music, which was close to both their hearts; the work of the historian; and also classical literature and newly-published books. Everyday politics is always present in the background. Haller’s words in particular about the military situation and the future of Germany towards the end of the Second World War are both fanciful and nightmarish. Because the two friends were consummate masters of the art of letter-writing, this edition is not only of significance for the history of art but also a stylistic pleasure.
