This book offers a clear, accessible account of the American litigation over the restitution of works of art taken from Jewish families during the Holocaust. For the past two decades, the courts of the United States have been an arena of conflict over this issue that has recently captured widespread public attention. In a series of cases, survivors and heirs have come forward to claim artworks in public and private collections around the world, asserting that they were seized by the Nazis or were sold under duress by owners desperate to escape occupied countries. Spanning two continents and three-quarters of a century, the cases confront the courts with complex problems of domestic and international law, clashes among the laws of different jurisdictions, factual uncertainties about the movements of art during and after the war, and the persistent question whether restitution claims have been extinguished by the passage of time.Through individual case studies, the book examines the legal questions these conflicts have raised and the answers the courts have given. From the internationally celebrated “Woman in Gold” lawsuit against Austria to lesser-known claims against Germany, Hungary, Spain, and museums and private collections in the United States, the book synthesizes the legal and evidentiary materials and judicial rulings in each case, creating a coherent narrative of proceedings that are often labyrinthine in complexity. Written by a leading authority on litigation and procedure, the book will be of interest to readers in various fields of the humanities and social sciences as well as law, and to anyone interested in the fate of artworks that have been called the “last prisoners” of the Second World War.

In the wake of the Nazi regime's policies, European Jewish cultural property was dispersed, dislocated, and destroyed. Books, manuscripts, and artworks were either taken by their fleeing owners and were transferred to different places worldwide, or they fell prey to systematic looting and destruction under German occupation. Until today, a significant amount of items can be found in private and public collections in Germany as well as abroad with an unclear or disputed provenance. Contested Heritage. Jewish Cultural Property after 1945 illuminates the political and cultural implications of Jewish cultural property looted and displaced during the Holocaust. The volume includes seventeen essays, accompanied by newly discovered archival material and illustrations, which address a wide range of topics: from the shifting meaning and character of the objects themselves, the so-called object biographies, their restitution processes after 1945, conflicting ideas about their appropriate location, political interests in their preservation, actors and networks involved in salvage operations, to questions of intellectual and cultural transfer processes revolving around the moving objects and their literary resonances. Thus, it offers a fascinating insight into lesser-known dimensions of the aftermath of the Holocaust and the history of Jews in postwar Europe.

This book is the second in a series of studies published under the auspices of the Institute for Holocaust Studies of the Graduate School and U niver sity Center of The City University of New York. Like the first book, it is an outgrowth of the lectures and special studies sponsored by the institute during the 1981-82 and 1982-83 academic years. This volume is divided into five parts. Part I, Ethics and the Holocaust, contains a pioneering investigation of one of the most neglected areas in Holocaust studies. Francine Klagsbrun, a well-known writer and popular lecturer, provides an erudite overview of the value of life in Jewish thought and tradition. With full understanding of the talmudic scholars' position on Jewish ethics and using concrete examples of the life-and death dilemmas that confronted many Jews in their concentration camp experiences, Klagsbrun provides dramatic evidence of the triumph of moral and ethical principles over the forces of evil during the Holocaust, this darkest period in Jewish history. The next two chapters, grouped under the heading The Allies and the Holocaust, deal with the failure of the Western Allies to respond to the desperate needs of the persecuted Jews of Europe during the Second World War. The first is by Professor Bela Vago, an authority on the Holocaust and East Central European history at the University of Haifa.

"Museums in Israel After the Holocaust explores the influence of the traumatic events of the Holocaust on the formation of a cultural heritage policy during the foundational years of the State of Israel. Based on primary research, the book offers a new understanding of cultural practices after the Second World War, while analysing the role of key Jewish cultural representatives who shaped museum collections that emerged during this period. The book investigates the ways Israel has dealt with the complicated history of 'heirless' Jewish cultural objects and questions of ownership, by providing a detailed examination of the process of allocation of 'heirless' Jewish cultural property handled by two American-Jewish organizations: the Jewish Restitution Successor Organization (JRSO) and the Jewish Cultural Reconstruction (JCR) in the immediate years following the Second World War. The book takes a material culture approach, which explores the meanings and values attached to an object over the course of time and during its transition between places and owners. Museums in Israel After the Holocaust is essential reading for academics, students and professionals working on and interested in Holocaust and Israel studies, art history, material culture studies, museum studies, cultural heritage and Middle Eastern Studies"--
