Hal-hal yang berhubungan dengan bisnis menuntut penyelesaian yang cepat dan dinamis, termasuk proses penyelesaian sengketanya. Penyelesaian sengketa bisnis dapat dilakukan melalui nonlitigasi dan litigasi. Saat sengketa bisnis harus diselesaikan secara litigasi, menjadi dilema tersendiri mengingat prosesnya memakan waktu yang lama dan kepastian yang terkatung-katung terhadap putusan tentu sangat merugikan bisnis itu sendiri. Oleh karena itu, dibentuklah Pengadilan Niaga pertama kali melalui Peraturan Pemerintah Nomor 1 Tahun 1998 tentang Perubahan Undang-undang tentang Kepailitan yang saat ini menjadi Undang-Undang Nomor 37 Tahun 2004 tentang Kepailitan dan Penundaan Kewajiban Pembayaran Utang, di Jakarta Pusat. Pengadilan niaga sebagai pengadilan khusus dibawah lingkungan badan peradilan umum menyelesaikan sengketa-sengketa dibidang niaga yang berhubungan dengan Kepailitan dan Penunduaan Kewajiban Pembayaran Utang, Sengketa Kekayaan Intelektual dan Penyelesaian Sengketa Likuidasi Bank Anggota Lembaga Penjamin Simpanan. Dengan adanya pembatasan waktu penyelesaian sengketa, ditiadakannya upaya hukum banding dan karakteristik khusus lain yang tidak dimiliki pengadilan lainnya, diharapkan pengadilan niaga selain dapat menyelesaikan sengketa bisnis yang ada, dapat juga mengakomodasi kebutuhan bisnis sehingga sengketa bisnis yang sedang diupayakan penyelesaiannya tidak menggangu aktifitas bisnis lainnya para pihak yang bersengketa.
