Hak tanggungan menurut Pasal 1 Undang-Undang Hak Tanggungan adalah hak jaminan yang dibebankan pada hak atas tanah sebagaimana dimaksud dalam Undang-Undang Nomor 5 Tahun 1960 tentang Peraturan Dasar Pokok-Pokok Agraria, berikut atau tidak berikut benda-benda lain yang merupakan satu kesatuan dengan tanah itu, untuk pelunasan utang tertentu yang memberikan kedudukan yang diutamakan kepada kreditur tertentu terhadap kreditur-kreditur lain. Hak tanggungan juga memberikan perlindungan yang seimbang antara para pihak, debitor, pemberi Hak tanggungan dan pihak ketiga. Perlindungan tidak hanya diberikan kepada kreditor, namun sampai pihak ke tiga khususnya kreditor lain dan pihak yang membeli objek hak tanggungan. Perlindunagn tersebut dituangkan dalam bentuk akta yaitu Akta Pembebanan Hak Tanggungan (APHT), bahwa akta tersebut harus memenuhi syarat spesialitas dalam APHT. Selain akta APHT harus dibuat secara otentik dan harus memenuhi asas publisitas dalam menandakan lahirnya Hak Tanggungan.
