Arus globalisasi yang kian gencar menerpa kehidupan yang tumbuh di masyarakat, kini menjadi suatu tantangan tersendiri untuk membentengi diri dari pengaruh buruk yang dapat mengancam persatuan dan kesatuan bangsa. Kendati demikian, kita sebagai bangsa Indonesia memiliki dasar negara yang disepakati adalah Pancasila yang berarti lima sila atau lima prinsip untuk mencapai atau mewujudkan tujuan bernegara. Lima prinsip Pancasila itu mencakup sila atau prinsip, yaitu: Ketuhanan Yang Maha Esa; Kemanusiaan Yang Adil dan Beradab; Persatuan Indonesia; Kerakyatan Yang Dipimpin Oleh Hikmat Kebijaksanaan dalam Permusyawaratan/Perwakilan; dan Keadilan Sosial bagi Seluruh Rakyat indonesia. Kelima sila tersebut dipakai sebagai dasar filosofis-ideologis untuk mewujudkan empat tujuan atau cita-cita ideal bernegara, yaitu: Melindungi segenap bangsa Indonesia dan seluruh tumpah darah indonesia; Meningkatkan kesejahteraan umum; Mencerdaskan kehidupan bangsa; dan Ikut melaksanakan ketertiban dunia berdasarkan kemerdekaan, perdamaian yang abadi, dan keadilan sosial. Pancasila lahir pada tanggal 1 Juni 1945, namun habitatnya sudah dipersiapkan jauh sebelum indonesia merdeka, bahkan sejak Dinasti Syailendra, bangsa Indonesia dengan gotong royong telah menghasilkan karya megah, besar yang menakjubkan dunia berupa Candi Borobudur. Tidak hanya itu, nilai-nilai lain pun telah berkembang juga sebelumnya, seperti: nilai kemanusiaan, nilai persatuan-kesatuan, nilai toleransi yang tinggi yang sudah tumbuh dan berkembang dari masyarakat indonesia yang akhirnya menjadi jiwa karakter dan kepribadian bangsa indonesia. Di sisi lain, indonesia sebagai negara yang berdasar atas hukum (rechtsstaat), tidak berdasarkan kekuasaan (machtsstaat), dan pemerintahan berdasarkan sistem konstitusi (Undang-Undang Dasar), bukan absolutism (kekuasaan yang tiada batas). Sudah sepantas-nya pembentukan Undang-Undang Negara Republik Indonesia menjadikan Pancasila sebagai ruh undang-undang. Untuk itu, muncullah pertanyaan bagaimana cara menanam-kan ruh Pacasila dalam undang-undang? Jawaban yang paling sederhana ialah dengan mentransformasikan nilai-nilai Pancasila di dalamnya. Namun demikian, jawaban tersebut harus pula dijelaskan secara ilmiah. Untuk itu, penulis uraikan secara lengkap tahap demi tahap transformasi norma fundamental negara (Staatsfundamentalnorm) ke dalam norma hukum, sehingga pembaca yang budiman secara singkat memahami arti pentingnya Pancasila dalam mengawal tujuan negara menuju negara yang sejahtera, mandiri, dan terbebas dari pengaruh kekuasaan bangsa lain. Have land reform movements ever managed to redistribute wealth, to encourage economic development, to improve standards of living, to ensure political stability? This book answers in the negative. Drawing upon land reform movements over twenty-six centuries of history, Tuma develops a hypothesis about land tenure reform that should enable other scholars to evaluate the success of past reform movements and to see the trends of present and future ones more clearly. In the first part of the study, a general definition of land tenure reform is advanced. Starting with the ordinary meaning of reform as "a redistribution of land to benefit the small farmer or landless agricultural worker," this definition is modified so as to take into account various forms of tenure of title to land, patterns of cultivation, terms of holding, and scale of operation. The middle section of the book presents a comparative study of different types of land reform movements. Eight major "case histories" are considered--the Greek reforms of Solon and Pisistratus in the sixth century B.C.; the Roman reforms of the Gracchi in the second century B.C.; the English tenure changes covering the commutations of the Middle Ages, and the enclosures of the sixteenth and eighteenth centuries; the reforms accompanying the French Revolution; the three Russian reforms: the emancipation of 1861, the Stolypin reforms of 1906 - 1911, and the Soviet reform beginning in 1917; the Mexican reform after the 1910 revolution; the Japanese reform after the Second World War; and the Egyptian reform starting in 1952. In sum, the book relates the land reform movements of past centuries to those now in progress in underdeveloped countries. It argues that the land reforms of the last two decades have dealt with symptoms rather than causes, have affected only a small percentage of either the population or the cultivable area, and warns that even if high concentrations of the land-holdings are broken down, reconcentration is likely to recur unless strong preventive measures are taken. "The Dutch colonial power in Indonesia in the nineteenth century needed to clarify its understanding of the legal values and conventions of the peoples whom it claimed to rule. Dutch colonial lawyers tended to rationalize this legal culture, lumping together all kinds of indigenous legal customs from different areas as manifestations of adatrecht, or, customary law. The status of this legal system vis-a-vis Dutch colonial law was a source of continual depute and disagreement. The champions of adatrecht known as the Leiden School, with C. van Vollenhoven in the forefront, scored a victory around 1927 when adatrecht gained official recognition, though on the other hand it became the subject of mounting criticism.
