In a new era of rising protests, social unrest and political discontent globally, especially over climate change, war dangers, austerity measures and social inequality, the right to protest is a critical democratic right. Yet it is increasingly controversial and subject to government reaction. This book poses a crucial question: how to defend and extend democracy? It examines the critical historical, social, political, ethical and legal issues raised by the basic democratic right to protest and the legislative and executive measures being taken by governments to restrict it. These measures are examined with a focus on three countries with an English legal heritage: the United States, Britain and Australia. These states are frequently held up as models of liberal democracies, respecting core legal and democratic rights. However, an examination shows that they have adopted far-reaching anti-protest laws and other provisions that threaten protest rights and genuine democracy itself. Violations of the right to the physical integrity of the person, such as torture, cruel and unusual punishment, extra-judicial executions, disappearances, and political imprisonment have long been treated as an anomaly in democratically governed societies. In the current literature on human rights, violations of this right are by-and-large seen as the hallmark of autocratic and repressive regimes. This study takes on this dominant paradigm and shows not only that the common assumption that democratic countries effectively limit human rights abuse is simply wrong, but that its widely accepted theory of what drives human rights violations accounts for only a small part of these abuses at best. Haschke shows that despite the increasing numbers of countries that are democracies, and despite growing numbers of national signatories to international treaties prohibiting human rights abuse, the number of allegations has not declined. This book also demonstrates that the bulk of this abuse, which takes the form of torture and ill-treatment, extra-judicial killings, rape, and the like, is committed against marginal members of society, seeming to reveal environments that enable agents of the state to abuse those with whom they are in contact. This violence is found in democracies and dictatorships alike. This work will be of interest to students and scholars of international relations, human rights and comparative politics.

This is the first comparative study of the relationship between social movements and citizenship rights. It identifies the main connections made between collective action and individual rights, in theory and history, and tests them in the context of modern authoritarian regimes. It does so bymeasuring both social mobilization and the presence of rights over time, and by analysing their mutual impact statistically - both within and across national cases. The results create a new perspective on democratic struggles in authoritarian conditions, and on processes of democratic transitions. The selected cases of Brazil, Chile, Mexico and Spain are similar enough to make comparisons possible, and different enough to make them interesting. Measuring mobilization and rights provides a comparative description of their forms and fluctuations, just as the statistical results promote acomparative analysis of their influence and interactions. The study uses statistical techniques, but employs them to illuminate historical processes. In sum, its quantitative methods work to enhance the qualitative inquiry, and together they come to constitute a robust defense of democracy as the direct result of collective struggles for individualrights.
