Buona parte della corrente retorica concernente i "diritti dei bambini" presenta, secondo l'autore di questo volume, non solo una intrinseca debolezza argomentativa, ma rischia di generare effetti perversi proprio laddove si propone di promuovere il benessere dell'infanzia: l'obiettivo è perciò quello di individuare le possibili conseguenze negative degli atti e delle decisioni espresse da tribunali e altre istituzioni che operano in questo campo, indagando le relazioni tra giudici ed esperti, e i rapporti tra sistema giuridico, psichiatria e servizio sociale. Sottolineando i limiti di tale approccio retorico al problema della tutela dei diritti, attraverso un'analisi comparativa, Michael King descrive "terapie", approcci e interventi innovativi destinati alle famiglie e all'infanzia. Il testo si caratterizza per le sue particolari qualità critiche e la novità del punto di vista, decisamente lontano dagli schemi drammatizzanti, attraverso cui viene letta oggi la condizione dell'infanzia. Un tratto distintivo che si apprezza in anni di ansie collettive per i bambini e di inquieto dibattito teorico, giuridico e sociale sui significati da attribuire all'infanzia e sulle tipologie d'intervento da intraprendere per garantire ai minori protezione dal danno e sviluppo delle potenzialità. Il libro può essere quindi letto come una guida per orientarsi consapevolmente in uno scenario in cui la dimensione e l'intensità degli allarmi riguardanti i bambini hanno raggiunto livelli esasperati, non sempre compatibili con un reale interesse per il loro benessere. Gli fa da supporto, conferendogli valore scientifico nell'ambito della sociologia del diritto e della teoria sociologica, un'articolata e sofisticata rivisitazione delle teorie di Niklas Luhmann.
