Il libro studia un tema poco affrontato in Italia, dalla recente dottrina del diritto pubblico ed amministrativo. La pubblica amministrazione scolastica, negli ultimi tempi, è stata, infatti, solamente l'oggetto di alcune pubblicazioni manualistiche oppure risulta trattata con un riferimento ad alcuni temi particolari, riguardanti l'autonomia o l'organizzazione del pubblico impiego nelle scuole: in tali studi, per un verso, sembra mancare un interesse verso una generale considerazione di quella parte della pubblica amministrazione, caratterizzata da alcuni principi generali, legati ai diritti connessi all'istruzione scolastica, tutelati anche negli ordinamenti ultrastatali. Per un altro verso, in tali studi, è assente il tentativo di cogliere le influenze provenienti dal diritto internazionale e sovranazionale, legate ai principi ed alla normativa sull'amministrazione scolastica: questo libro tenta, perciò, di affrontare tale tema, studiandolo nella prospettiva dell'interazione tra gli ordinamenti statali ed ultrastatali, con un particolare riferimento al diritto dell'Unione Europa. Questo esame appare, così, interessante, poiché mostra il rilievo di alcuni principi generali, aventi un'origine nel diritto internazionale ed idonei a porsi come l'unitario fondamento di un sistema normativo, amministrativo ed integrato, sull'istruzione, il quale dimostra anche le caratteristiche e le problematiche dell'attuale evoluzione del diritto pubblico statale. Nel libro, le dinamiche indicate sono colte anche con qualche riflessione sul sistema scolastico italiano, che è utilizzato come un significativo elemento comparativo e dimostra le principali implicazioni della descritta influenza ultrastatale: il medesimo libro si conclude con alcune riflessioni sui possibili rimedi prospettabili rispetto alle criticità ed alle aporie delineate nella descritta evoluzione del diritto pubblico ed amministrativo, le quali appaiono evidenti proprio nell'integrazione dei ricordati sistemi normativi ed amministrativi,così diversi e complessi. L'istruzione è, però, studiata con un'esclusiva attenzione all'ambito scolastico e una diversa parte relativa alla normativa ed alla pubblica amministrazione universitaria rimane, perciò, estranea al libro, che, oltre a proporsi come un tentativo di uno studio avente una possibile finalità di un approfondimento scientifico sui temi indicati, può essere, comunque, utile anche per l'approfondimento dei temi connessi all'amministrazione scolastica, interessanti per la preparazione degli esami universitari e dei concorsi pubblici sul diritto pubblico scolastico.
