English summary: It is understood that a stipulation stands as a paradigm for an obligation. Certain contractual clauses, however, have assured the succession not only of the heirs, but even of successors to a single right of the creditor or the debtor. For the first time, Thomas Finkenauer demonstrates this break with the allegedly axiomatic dogma of the Roman law. German description: Die Stipulation gilt als Paradigma des schuldrechtlichen Vertrags. Mehrere Rechtsregeln schliessen die Einbeziehung dritter Personen aus. Jedoch kennen die Quellen mit der Erben- und der Nachfolgeklausel auch Vertrage mit Drittbezug. Wahrend sich mit der Erbenklausel allmahlich der Gedanke der Universalsukzession in das Versprechen durchsetzte, konnten die Parteien mit der Nachfolgeklausel sogar ihre Einzelrechtsnachfolger berechtigen und verpflichten und so Drittwirkung erzielen. Die romischen Juristen entschieden sich damit gegen die Anwendung starrer Rechtsregeln und fur die Bedurfnisse des Rechtsverkehrs. Die Erkenntnis dieses Bruchs mit einem scheinbar unumstosslichen Dogma ist der Romanistik aufgrund ubertriebener Textkritik bisher versperrt geblieben. Thomas Finkenauer stellt die Stipulation als Instrument privatautonomer Rechtsetzung von ausserordentlicher Flexibilitat vor.
