"Principi e metodo nell'esperienza giuridica" è una raccolta di scritti rivolta a studiosi del diritto.Responsabilità, uguaglianza, abuso, buona fede, equivalenza, proporzionalità, adeguatezza, precauzione, ragionevolezza, bilanciamento, sussidiarietà sono espressioni elastiche. I valori e gli interessi presidiati descrivono “volumi” applicativi diversi, condizionati da istanze ideologiche o esistenziali. I principi non delineano fattispecie, ma costituiscono “pesi” che incidono sulle decisioni. Ma il punto non è demarcare il ragionamento per principi da quello per fattispecie quanto, piuttosto, l’impiego che si fa degli strumenti per la soluzione di un problema. Se il principio è norma senza fattispecie, esso non può prescindere dalla fattispecie stessa, caso concreto di cui concorre a definire il regime. Un principio, da solo, non ha senso; lo acquisisce quando vive in un caso reale. Gli orizzonti aperti dalla normazione per principi arricchiscono i criteri di giudizio, ma non trasformano il panorama del diritto.Il volume Principi e metodo nell'esperienza giuridica si sofferma su alcuni principi, cercando di coglierne il ruolo nel funzionamento del diritto civile, e su altre questioni di metodo.
