La riforma Cartabia, adottata con la legge delega 206/2021 e con il d.lgs. 149/2022, ha fornito l’occasione per rimeditare sul tema degli strumenti di risoluzione delle controversie al di fuori della giurisdizione, posti al centro di una delle linee di intervento, e sul loro rapporto con il processo. La cornice in cui si collocano le novelle normative è quella del Piano nazionale di Ripresa e Resilienza (PNRR), varato dall’Unione Europea a riparare i danni economici e sociali causati dall’emergenza sanitaria da Coronavirus e contribuirà a gettare le basi per rendere le economie e le società dei Paesi europei più sostenibili, resilienti e preparate alle sfide e alle opportunità della transizione ecologica e digitale. Nella parte dedicata alla giustizia si rinviene un’analisi che valorizza l’autonomia, l’indipendenza e l’alto profilo di professionalità dei magistrati, in un contesto che, però, soffre del fondamentale problema dei tempi di celebrazione dei processi, la cui durata incide negativamente sulla percezione della qualità della giustizia resa nelle aule di tribunale, secondo la nota massima per cui “giustizia ritardata è giustizia denegata”. Nelle Country Specific Recommendations indirizzate al nostro Paese negli anni 2019 e 2020, la Commissione Europea, pur dando atto dei progressi compiuti negli ultimi anni, invita l’Italia ad aumentare l’efficienza del sistema giudiziario civile. Viene dunque individuata la necessità di una riforma del settore giustizia civile con l’obiettivo di riportare il processo italiano a un modello di efficienza e competitività.

Non vi è dubbio che la così definita “crisi della giustizia (civile)” sia stato e tuttora rimanga un refrain tanto in parte realistico quanto in buona misura declinato (dai più) sui tempi di formazione della res judicata, in molti casi reso quasi inaccettabile e soprattutto incompatibile con gli standards europei e in sé e per sé con la stessa dimensione dell’effettività della tutela dei diritti. La stimolata occasione di raccogliere alcuni studi - di un arco temporale relativamente breve, pur denso di accadimenti e di riforme processuali - vuole significare non solo una sorta di concisa glossa dei medesimi, ma in particolare il possibile ruolo dello scholar, non rinchiuso nella turris eburnea dell’accademia, ma inserito nella di questa funzione educativa e scientifica con approccio critico e, ove utile, non meramente parrocchiale. Il difficile compito dello scholar, di riuscire a coniugare l’approccio concettuale con la possibile incidenza pratica e applicativa della speculazione del pensiero scientifico rappresenta così il fil rouge di questo “volumetto”; ed è proprio il settore della “giustizia civile” che viene ad assumere un ruolo cruciale nel tentativo di reductio ad unum dei valori essenziali dell’ordinamento giuridico, che concretano forse il più internazionale riconosciuto stilema delle c.d. “scienze sociali”: ubi societas, ibi ius.
