La recente decretazione d’urgenza ha introdotto numerose e dirompenti innovazioni nel sistema degli appalti pubblici. Il decreto 66/2014 (c.d. “Spending Review 3”, convertito con L. 89/2014) ha previsto nuove norme nella gestione degli acquisti di beni e servizi delle PA, con l’obiettivo di conseguire risparmi di spesa e rafforzare i principi di trasparenza e correttezza dell’azione amministrativa. Le nuove disposizioni operano, nel settore dei contratti pubblici, su due distinti piani, peraltro tra loro comunicanti nella ricostruzione sistematica del quadro degli acquisti di beni e servizi: da un lato si introducono vincoli economico-finanziari (riduzione del 5% e rinegoziazione contratti in essere, rispetto prezzi massimi di aggiudicazione per i nuovi affidamenti), mentre dall’altro si pongono le stringenti misure sulle procedure di affidamento, valorizzando ulteriormente la centralizzazione e l’azione dei soggetti aggregatori. Come avvenuto per gli altri provvedimenti di Spending Review 1 e 2, il “mosaico” normativo, a “geometria variabile” in funzione della tipologia di amministrazione e della tipologia di servizi e fornitura, si presenta di non agevole ricomposizione. Il D.L. 90/2014 (Semplificazione PA) ha poi introdotto ulteriori importanti novità (semplificazione oneri formali, soppressione AVCP, revisione incentivi, ecc.). In particolare, le norme dell’art. 39 aprono un nuovo scenario sul versante delle esclusioni per ragioni formali nelle gare, insieme a forti criticità applicative. Da ultimo, il D.L. 133/2014 (Sblocca Italia) è intervenuto, in particolare, nel settore dei lavori pubblici con la previsione di norme speciali (acceleratorie e semplificatorie) per determinate tipologie di appalti (edilizia scolastica, adeguamento normativa antisismica, vincolo idrogeologico e bonifica siti contaminati).
