Comment et pourquoi la philosophie juridique et politique contemporaine est-elle revenue à Kant ? Il faut, pour le comprendre, s’intéresser d’abord à l’ancrage de la pensée du droit dans la théorie kantienne de la raison pratique et aux problèmes que pose le statut kantien d’une raison normative oeuvrant dans les deux champs coordonnés de l’éthique et du droit. L’articulation entre droit privé et droit public, entre droit et politique dans la Métaphysique des moeurs doit être considérée en relation avec l’exigence d’une fondation unitaire du système des normes pratiques. La philosophie politique de Kant peut dès lors être envisagée dans le prolongement que lui offre sa théorie du droit international, avec l’ouverture d’une perspective cosmopolitique qu’il importe de définir avec précision. Ce travail s'interroge sur la signification et la portée du concept de « souverain Bien » dans la philosophie pratique de Kant. Comment justifier l'affirmation kantienne selon laquelle le souverain Bien est l'objet nécessaire et a priori de la raison pratique pure ? L'objectif de la thèse est de chercher à rendre compte de ce moment téléologique qui surgit dans la « Dialectique de la raison pratique pure » et que la théorie normative exposée dans « l'Analytique » semble pourtant rendre inutile. L'aspiration au souverain Bien est nécessaire a priori parce qu'elle participe de l'inévitable et naturel élan métaphysique de la raison à l'inconditionné. On cherche ensuite à fonder la nécessité pratique du souverain Bien en montrant que si le souverain Bien ne fait pas partie des concepts fondamentaux de l'éthique, il fait cependant partie des concepts fondamentaux de l'application de l'éthique au contexte d'une volonté morale finie. Enfin, la nécessité morale de la tâche de promouvoir de souverain Bien vient ce que celle-ci est à rapporter à l'exigence immanente de la raison pratique de chercher à s'appliquer dans le monde.

Why read Kant's Critique of Judgment? For most readers, the importance of the work lies in its contributions to aesthetics and, to a lesser extent, the philosophy of biology. Hannah Ginsborg, by contrast, sees the Critique of Judgment as a central contribution to the understanding of human cognition generally. The fourteen essays collected here advance a common interpretive project: that of bringing out the philosophical significance of the notion of judgment which figures in the third Critique and showing its importance both to Kant's own theoretical philosophy and to contemporary views of human thought and cognition. For us to possess the capacity of judgment, on the interpretation defended here, is for our natural perceptual and imaginative responses to involve a claim to their own normativity with respect to the objects which cause them. It is in virtue of this capacity that we are able not merely to respond discriminatively to objects, as animals do, but to bring objects under concepts. The Critique of Judgment, on this reading, rejects the traditional dichotomy between the natural and the normative: our natural psychological responses to the spatio-temporal objects which affect our senses are both causally determined by those objects, and normatively appropriate to them. The essays in this book aim collectively to develop and illuminate this understanding of judgment in its own right, and to use it to address specific interpretive issues in Kant's aesthetics, theory of knowledge, and philosophy of biology; they are also concerned to bring out the relevance of this conception of judgment to contemporary debates regarding concept-acquisition, the content of perception, and skepticism about rules and meaning.
