Scopo di questo lavorò sarà quindi verificare l’ammissibilità dell’applicazione dell’istituto del trust, oggi utilizzato soprattutto nel diritto societario e nel diritto di famiglia, anche all’ambito culturale, con un occhio rivolto alla legislazione dei beni culturali. Innanzitutto si analizzeranno i suoi aspetti primari, studiandone gli effetti, la natura giuridica e il ruolo dei soggetti coinvolti, con particolare riferimento ai beneficiari, in quanto permettono di distinguere l’applicazione del trust all’ambito culturale rispetto agli altri ambiti più comuni. In un secondo momento si focalizzerà l’attenzione sull’oggetto del trust e sulle caratteristiche che questo può assumere se applicato all’ambito culturale. Pur riconoscendo che in questo settore il trust non può avere una rilevanza importante a livello sociale quanto quella che può avere una fondazione di partecipazione, si ritiene comunque che questo istituto offra alcuni vantaggi, come ad esempio il fatto di poter vincolare il proprio patrimonio culturale ad un determinato scopo, proteggendolo contestualmente da un’eventuale dispersione e favorendo allo stesso tempo i beneficiari, ai quali viene offerta la possibilità di disporre, seppur indirettamente, dei beni vincolati e di avvantaggiarsene. Infine nell’ultima parte del lavoro, verrà svolto un confronto tra il trust e gli istituti tipicamente impiegati nell’ambito no profit, con particolare attenzione alle fondazioni di partecipazione, allo scopo di valutarne somiglianze e differenze.
