The definition of organised crime has long been the object of lively debate, at national and international level. Sociological and legal analysis has not yet led to one definitive answer to the question of what exactly 'organised crime' means. Nonetheless, many instruments adopted both at international and national levels set forth special legal regimes designed to target criminal groups featuring a stable organisation, which are perceived as particularly dangerous to society. Therefore, identifying the notion of organised crime is crucial to establishing the scope of any legal instrument specifically designed for combating it. The aim of this book is to reassess the scope, the effectiveness and the overall coherence of existing definitions of organised crime, and to identify any need for a reconsideration of these definitions, specifically with reference to the EU legal order. The Oxford Handbook of Italian Politics provides a comprehensive look at the political life of one of Europe's most exciting and turbulent democracies. Under the hegemonic influence of Christian Democracy in the early post-World War II decades, Italy went through a period of rapid growth and political transformation. In part this resulted in tumult and a crisis of governability; however, it also gave rise to innovation in the form of Eurocommunism and new forms of political accommodation. The great strength of Italy lay in its constitution; its great weakness lay in certain legacies of the past. Organized crime—popularly but not exclusively associated with the mafia—is one example. A self-contained and well entrenched 'caste' of political and economic elites is another. These weaknesses became apparent in the breakdown of political order in the late 1980s and early 1990s. This ushered in a combination of populist political mobilization and experimentation with electoral systems design, and the result has been more evolutionary than transformative. Italian politics today is different from what it was during the immediate post-World War II period, but it still shows many of the influences of the past.

Mafia-type organizations generate several distorting effects on the economy. In Italy their presence is endemic, and not only in Southern regions such as Sicily, Campania or Calabria. Such organizations endure the fierce and continuous pressure exerted by Italian anti-mafia policy, maybe the most articulate and effective such policy in the world. Nevertheless, they have survived by submerging, transforming, and relocating their operations. The analysis of the different Mafias of today benefits from a huge amount of empirical data produced by investigators. This allows us to outline more reliable indexes of the penetration of Mafiosi in given territories, as well as to estimate the size of their activities in a transparent and empirically testable way. The contributions gathered in this book stem from the application of an innovative methodology originally introduced by the Fondazione Rocco Chinnici, and they enlarge our understanding of such a complex and dynamic phenomenon. After the presentation of the approach, the chapters are devoted to the Camorra's present situation, to an estimate of the size of extortion, to a comparison between Cosa Nostra and Camorra, to the analysis of wiretapped conversations and, finally, to the delocalization of Mafias and the perspectives of a European anti-mafia policy. This book was originally published as a special issue of Global Crime.

Il volume affronta, in modo organico e completo, le tematiche giuridiche poste dalle associazioni di tipo mafioso, sia dal punto di vista del diritto penale sostanziale che da quello dei profili processualpenalistici, nonché con riferimento alle misure di prevenzione e all’esecuzione della pena detentiva. La trattazione, che pone specifica attenzione ai profili applicativi dovuti all’evoluzione giurisprudenziale e approfonditi dalla più recente dottrina, è aggiornata alla luce delle recentissime leggi del 22 maggio 2015, n. 68, recante “Disposizioni in materia di delitti contro l’ambiente”, e del 27 maggio 2015, n. 69, recante “Disposizioni in materia di delitti contro la pubblica amministrazione, di associazioni di tipo mafioso e di falso in bilancio”. In particolare, si realizza una sistematizzazione generale dei reati associativi, ponendoli al cospetto dei princìpi generali costituzionalmente garantiti e di quelli penalisticamente riconosciuti. Si pone poi particolare attenzione al delitto di cui all’art. 416-bis del codice penale, oggi denominato “associazioni di tipo mafioso anche straniere”, e al delitto di scambio elettorale politico-mafioso, disciplinato nel successivo art. 416-ter c.p., come riformato dalla legge 17 aprile 2014, n. 62, approfondendo la tematica dei delitti-fine e del concorso esterno, delle circostanze, nonché i rapporti con altre figure di reato, e la responsabilità degli enti. Inoltre particolare vengono approfonditi i temi relativi a competenza, custodia cautelare, cautele patrimoniali, regime delle intercettazioni, operazioni sotto copertura, requisiti della prova e deroghe al processo penale, che fanno parlare di un vero e proprio “doppio binario” in materia di processi di criminalità organizzata. Nel volume si trattano, ancora, i temi legati alle conseguenze giuridiche dei reati di criminalità organizzata, con il discusso regime di cui all’art. 41-bis dell’ordinamento penitenziario. Particolare attenzione, infine, è riservata alle misure di prevenzione, alla luce dell’entrata in vigore del c.d. nuovo codice antimafia: dalla confisca di prevenzione alle relative impugnazioni, ai delicati rapporti tra processo penale e processo di prevenzione.
