L’opera ha l’obiettivo di analizzare le complesse tematiche che si pongono nella gestione del demanio marittimo e lacuale con finalità turistico ricreative, tanto per quel che concerne l’individuazione e la natura del “bene demanio”, quanto per ciò che riguarda la sua concessione in uso esclusivo a Soggetti imprenditoriali che operano professionalmente nel settore e che dalla medesima gestione ricavano “occasioni di guadagno”. Il “bene demanio”, soprattutto marittimo in relazione all’accentuata mutevolezza dello stato dei luoghi per effetto dell’azione del mare e di altri agenti naturali, proprio per la sua “naturalità” modifica frequentemente l’estensione e perciò la sua incidenza sugli adiacenti beni privati; a fronte di ciò la delimitazione in sede amministrativa del demanio è ancor oggi riferita a vecchie “forme di divisione” non più attuali e risulta affidata ad un procedimento lungo e farraginoso, che si pone in antitesi con la sempre più frequente domanda di utilizzo a fini economici di tale bene, domanda che esige risposte celeri ed in sicurezza. E così sorgono, spesso, contestazioni e controversie sull’estensione dei diritti delle Parti contrapposte. Allo stesso tempo il “bene demanio” per finalità turistico-ricreative ha riscontrato un sensibile aumento di interesse da parte dell’Imprenditoria, non solo nazionale e questo ha posto il problema delle concessioni, della loro durata, delle modalità di assegnazione e dell’assoggettamento a regole di concorrenzialità, che non erano usuali nell’ambito del tradizionale sistema di affidamento di tale bene pubblico. Da qui numerose controversie, la rimessione delle tematiche sia alla Corte Costituzionale che al Giudice comunitario e le rilevanti pronunce che, a partire da almeno un quindicennio a questa parte, hanno cambiato sensibilmente la percezione della questione inerente le concessioni. Tutti questi temi sono stati affrontati nel testo, a cura di Operatori del settore e Funzionari della Pubblica Amministrazione, quotidianamente alle prese con i concreti problemi posti dalla gestione del demanio marittimo e lacuale.
