Con questo studio si analizzano in chiave storico-ricostruttiva le diverse modalità di ripartizione del contenzioso civile fra forme (ordinarie) di trattazione a cognizione piena e procedimenti di natura sommaria. In particolare si intende segnalare come le recenti proposte di modifica del processo civile – mediante le quali si prospetta l’adozione del procedimento sommario di cognizione ex art. 702-bis c.p.c. quale regola procedimentale per la risoluzione di tutte le controversie – non costituiscano affatto una novità per l’ordinamento italiano. Tuttavia, proprio in prospettiva di riforma, l’indagine storica dei diversi modelli di coesistenza fra rito ordinario e rito sommario nella storia del processo civile italiano (dalle legislazioni degli Stati preunitari sino al codice del ’42) evidenzia la necessità di configurare modalità differenziate di risoluzione delle controversie in ragione della loro diversa complessità. Il tutto in un’ottica di efficiente allocazione delle risorse giudiziarie. Vincenzo Ansanelli è Ricercatore confermato di Diritto processuale civile presso l’Università degli Studi di Genova.
