From 1938 until 1943 - before the German occupation and accompanying Holocaust - Fascist Italy drafted and enforced a comprehensive set of anti-Semitic laws. Notwithstanding later rationalizations, the laws were administered with a high degree of severity and resulted in serious damage to the Italian Jewish community. Written from the perspective of an American legal scholar, this book constitutes the first truly comprehensive survey of the Race Laws in the English language. Based on an exhaustive review of Italian legal, administrative and judicial sources, together with archives of the Italian Jewish community, Professor Michael A. Livingston demonstrates the zeal but also the occasional ambivalence and contradictions with which the Race Laws were applied by the Italian legal order and ordinary citizens. Fascism was one of the twentieth century's principal political forces, and one of the most violent and problematic. A ottant’anni dall’emanazioni delle leggi razziali fasciste e in un clima di rinascente antisemitismo, vengono passati in rassegna il contesto italiano delle leggi razziali del 1938 e le concezioni coeve sulla purezza della stirpe, nonché i documenti e le norme in cui queste ultime trovarono riflesso. Nel dopoguerra, le leggi razziali vennero abrogate e i colpevoli condannati. Molti sfuggirono però alla punizione grazie all’”Amnistia Togliatti” del 1946 e all’”Amnistia Azara” del 1953, esaminate in dettaglio come esempi di giustizia transizionale. Inoltre, dal dopoguerra a oggi, ritornarono ad affiorare e a intensificarsi – non solo in Europa – le mai estinte concezioni di estrema destra, tra cui nuovamente l’antisemitismo. L’appendice del volume contiene cinque bibliografie degli scritti pubblicati negli ultimi tempi su questi temi: i libri dei sopravvissuti ai campi di sterminio; gli scritti sulle leggi razziali del 1938 pubblicati tra il 2017 e il 2021; quelli sulle due amnistie postbelliche; infine, quelli sulla giustizia transizionale. Il testo delle due amnistie è riportato in appendice insieme con quello della “Legge sulla reintegrazione dei diritti civili e politici” del 1944, destinata a chi ne era stato privato durante il fascismo. Ricordare gli errori e gli orrori del passato può contribuire ad evitare il loro ripetersi.
