Sotto questo profilo, il D.L. n. 101/2019 (conv. in L. 128/2019) ha esteso nei loro confronti una serie di tutele “minime” previste per i lavoratori subordinati, quali ad esempio: - la forma scritta ad probationem per i contratti di lavoro - l’applicazione della contrattazione collettiva per la determinazione dei compensi - la copertura assicurativa obbligatoria. La ricognizione delle ultime pronunce giurisprudenziali di merito (in particolare Trib. Bologna 31 dicembre 2020 e 30 giugno 2021, Trib. Palermo 12 aprile 2021) offre l’occasione per riflettere sulla qualificazione dei riders anche ai fini degli obblighi della sicurezza del lavoro, della tutela della salute e di quella sindacale e, più in generale, dei profili giuslavoristici della c.d. gig economy che richiede nuove soluzioni normative per garantire una copertura giuridica più adeguata alle nuove tipologie lavorative.
