La regola come parametro di soluzione della controversia trova il suo luogo nel processo. Quindi, controversialità e processualità rappresentano la dimensione costitutiva dell’ordinamento giuridico romano, oltre la legge almeno fino al III secolo d.C. Nelle ricerche raccolte nel presente volume, ci si interroga su alcuni aspetti emblematici del processo civile romano, tra i quali: il rapporto intercorrente tra giudice, giurista e norma, con la ridefinizione di ius controversum come diritto fondato sulle controversie, oltre che di diritto come scientia iuris controversiale; la nascita e il valore delle regulae iuris come strumenti ermeneutici, in opposizione alla norma come regola generalizzata e volatizzata rispetto al fatto; l’officium iudicis e l’istituto del non liquet nella sua accezione di potere discrezionale oltre il sistema delle regulae iuris. Queste manifestazioni del fenomeno normativo vengono analizzate in una feconda prospettiva di continuità temporale, che riunisce moderno e antico in un comune processo nomopoietico.Antonio Palma, professore ordinario di Istituzioni di diritto romano nell’Università degli Studi di Napoli Federico II e docente presso la Scuola di Alta Formazione in Diritto Romano dell’Università di Roma La Sapienza, è autore di numerosi saggi e monografie, tra queste: Le ‘curae’ pubbliche.
