La rivista AmbienteDiritto sin dalla sua nascita (oltre 20 anni fa) si propone di accompagnare sia da un punto di vista giurisprudenziale, che dottrinario gli operatori del diritto nello studio dell’affascinante e poliedrica “metamateria” rappresentata dal diritto ambientale. Forti di questa esperienza, fra i primi abbiamo posto il problema del governo dell’emergenza nella società del rischio, che è tema, come purtroppo noto, di sempre più rilevante attualità. In tempi non sospetti abbiamo organizzato a Roma, con il patrocinio degli organi parlamentari, il Convegno “Emergenza e Tutela ambientale” ed abbiamo immaginato insieme all’Editore della Rivista di inaugurare una collana di volumi “stampati” che possa raccogliere sul tema contributi e idee di cultori della materia per offrirli alla riflessione di un più vasto pubblico. Questo primo volume, raccoglie alcuni dei numerosi contributi che sono stati esposti al Convegno insieme ad altri saggi che hanno già trovato spazio nelle pagine della rivista on-line (www.ambientediritto.it). Tuttavia, non potevamo non fare riferimento all’attualità e all’emergenza determinata dal CORONAVIRUS. Nel cercare di individuare un filo conduttore ai saggi contenuti in questo volume, anche se le questioni esaminate riguardavano prevalentemente argomenti attinenti alle emergenze variamente aggettivate come emergenza ambientale, energetica, sismica ... sono affiorate convergenti istanze volte ad affrontarne la complessiva problematica, avvertendosi l’opportunità di un assetto unitario della regolazione delle sospensioni costituzionali e delle deroghe a quel che è rimasto del simulacro principio di legalità (P. Grossi, Ritorno al diritto). Ciò per rispondere all’esigenza che, secondo Costantino Mortati, al fine di ‹‹evitare quanto possibile l’arbitrio e mantenere anche nei casi di emergenza alcune garanzie formali proprie dello Stato di diritto››, avrebbe indotto ‹‹ad includere nelle costituzioni contemporanee una qualche disciplina delle sospensioni stesse per quanto riguarda sia l’organo competente a dichiarare la sussistenza degli eventi straordinari e ad assumere i poteri dai medesimi richiesti, sia le modalità di emissione e le specie delle misure destinate a fronteggiarli, sia i controlli sulle medesime›› (Costituzione - Dottrine generali, in E.d.d., XI, Milano, 1962, p.194).
