Il ne bis in idem, quale principio tradizionalmente volto ad assicurare la certezza del giudicato penale, ha subito nel corso degli anni una vera e propria evoluzione in chiave ascendente, al punto da configurarsi quale diritto fondamentale dell’individuo. Questo percorso, avviato sotto la spinta propulsiva della giurisprudenza sovranazionale, non può peraltro dirsi compiuto: lo dimostra la continua produzione giurisprudenziale interna ed europea, talvolta anche in discontinuità con il passato. Il volume intende tracciare in modo nitido le tappe di questo itinerario, con l’obiettivo di offrire delle chiavi di lettura alle numerose e sempre nuove questioni applicative irrisolte, sul versante sia sostanziale sia processuale. Fa da sfondo a questa ricostruzione, nel passaggio dalla dimensione strettamente interna del ne bis in idem a quella sovranazionale – ad oggi molto “sfuggente” – la tensione verso la massima espansione del principio in funzione di tutela del soggetto coinvolto in plurimi procedimenti, non soltanto penali.

The book “Criminal proceedings, languages and the European Union: linguistic and legal issues” – the first attempt on this subject – deals with the current situation in the jurislinguistic studies, which cover comparative law, language and translation, towards the aim of the circulation of equivalent legal concepts in systems which are still very different from one another. In the absence of common cultures and languages, in criminal procedure it is possible to distinguish features that are typical of common law systems and features that are typical of civil law systems, according to the two different models of adversarial and inquisitorial trials. Therefore, the most problematic challenges are for the European Union legislator to define generic measures that can be easily implemented at the national level, and for the individual Member States to choose corresponding domestic measures that can best implement these broad definitions, so as to pursue objectives set at the European level. In this scenario, the book assesses the new framework within which criminal lawyers and practitioners need to operate under the Lisbon Treaty (Part I), and focuses on the different versions of its provisions concerning cooperation in criminal matters, which will need to be implemented at the national level (Part III). The book analyses the issues raised by multilingualism in the EU decision-making process and subsequent interpretation of legal acts from the viewpoint of all the players involved (EU officials, civil, penal and linguistic lawyers: Part II), explores the possible impact of the EU legal acts concerning environmental protection, where the study of ascending and descending circulation of polysemantic words is especially relevant (Part IV), and investigates the new legal and linguistic concepts in the field of data retention, protection of victims, European investigation orders and coercive measures (Part V).

Il ne bis in idem è tornato oramai da anni al centro del dibattito scientifico per il rinnovato interesse che ha suscitato la sua estensione – per via giurisprudenziale – agli illeciti amministrativi punitivi, nell’ambito dei sistemi caratterizzati dal doppio binario sanzionatorio, effetto del noto ampliamento della nozione di matière pénale. Tuttavia vi è una prospettiva del ne bis in idem applicato ai doppi binari rimasta finora inesplorata in dottrina, dal momento che il riconoscimento del divieto di un nuovo procedimento per il medesimo fatto, quando un altro formalmente o sostanzialmente penale si sia irrevocabilmente concluso, è stato approfondito presupponendo che il primo fosse stato definito con un provvedimento di condanna. Cosa accade, invece, a fronte di un proscioglimento? Scopo della ricerca è verificare prima di tutto se ed eventualmente come impatti un proscioglimento rispetto ad un nuovo accertamento sanzionatorio. Se, cioè, possa precluderlo e se l’applicazione della garanzia possa dipendere dal tipo di provvedimento liberatorio o dalla ragione che vi è sottesa o dall’autorità (penale o amministrativa) che lo abbia pronunciato. Considerato che la giurisprudenza europea ha valorizzato, nella costruzione del principio, il criterio della proporzionalità, tale criterio sembra dover trovare la sua declinazione per il ne bis in idem dei doppi binari – come pare suggerire la Corte di giustizia – anche a fronte di un proscioglimento.
