Le novità normative degli ultimi anni, dai decreti legislativi attuativi della legge delega n. 124/2015, sino all'entrata in vigore del nuovo CCNL 21.5.2018 per arrivare ai recenti interventi normativi in materia di capacità assunzionali, richiedono una sistematizzazione di tutti gli aspetti che concernono il rapporto di lavoro alle dipendenze delle Amministrazioni regionali e locali, dagli atti di macro organizzazione alla gestione del rapporto di lavoro, attraverso atti datoriali di micro organizzazione. Muovendo da questa esigenza, il volume affronta, in modo completo, tutti gli aspetti che riguardano la gestione del rapporto di lavoro alle dipendenze di tali Amministrazioni, dalla programmazione del fabbisogno, alla gestione delle procedure di accesso, dal contratto individuale, all'orario di lavoro, dal trattamento economico, alle ferie, dalla malattia, ai permessi ed ai congedi, dalle responsabilità, alla cessazione del rapporto di lavoro. Tutti gli istituti che vengono trattati, oltre ad una disamina generale anche alla luce della evoluzione giurisprudenziale, sono sviluppati con riferimento sia agli aspetti normativi, con una esemplificazione di immediata comprensione e validità generale, dei singoli istituti, sia alle diverse soluzioni applicative ipotizzabili in termini di disciplina interna, soffermando l'attenzione sulla ripartizione tra atti rientranti nella competenza degli organi i governo dell'Ente, tra i quali il regolamento sull'ordinamento degli uffici e dei servizi, ed atti di natura datoriale di diritto privato affidati ai competenti organi gestionali dell'Amministrazione, ovvero i dirigenti, nell'esercizio dei poteri e delle facoltà del privato datore di lavoro agli stessi riconosciuti dall'art. 5, comma 2, del Dlgs. n. 165/2001. Il volume contiene, poi, un'utile appendice nella quale vengono commentate le disposizioni, emanate attraverso il ricorso alla decretazione d'urgenza e ad appositi provvedimenti del Presidente del Consiglio dei Ministri, per le parti che si riflettono sugli istituti giuridici ed economici del rapporto di lavoro nelle Regioni e negli Enti locali ed introdotte per affrontare la diffusione pandemica del virus COVID-19. Alcune di queste disposizioni, infatti, segneranno, anche per il futuro, il rapporto di lavoro dei dipendenti pubblici.
