The European Commission has taken a series of targeted and horizontal measures to curb the spread of illegal content online, including on such as hate speech, child sexual abuse material, incitement to terrorism, consumer scams and content that infringes intellectual property rights. On 28th September 2017 the Commission adopted a Communication on tackling illegal content online, towards enhancing responsibility of online platforms. Following on from this, on March 1 2018, the Commission issued a Recommendation on measures to effectively tackle illegal content online. This Recommendation emphasises the need for online platforms to take greater responsibility when it comes to the governance of online content. It clearly sets out the processes online platforms should put in place to enhance the detection and removal of illegal content. These include clearer rules for notifying illegal content, more proactive tools and technologies to identify and remove illegal content, and, importantly, stronger safeguards to ensure decisions to remove content are accurate and well-founded2. To explore Europeans' experience of illegal content online, and their opinions about the role and responsibility of online platforms, this survey explores the following areas: The use of various types of online hosting services; Views about the safety of the Internet and addressing illegal content online; The types of illegal content encountered online, the actions taken as a result, and satisfaction with the hosting service's response; Respondents' experiences of having legal content wrongfully blocked, the reasons given for this and including the actions taken as a result; Opinions about the actions Internet hosting services should take to address illegal content online, including content removal and the right of appeal. This survey was carried out by the TNS Political & Social network in all 28 Member States of the European Union, between 18 and 26 June 2018. Some 33,244 respondents from different social and demographic groups were interviewed via telephone in their mother tongue on behalf of the Directorate-General for Communications Networks, Content and Technology (DG CONNECT). The methodology used is that of Flash Eurobarometer surveys as carried out by the Directorate- General for Communication "Media monitoring, media analysis and Eurobarometer" Unit). A technical note on the manner in which interviews were conducted by the Institutes within the TNS Political & Social network is appended as an annex to this report. Also included are the interview methods and confidence intervals.

Across the member states of the Council of Europe, both the blocking and removal of online material are frequently treated in a similar way. However, the existence or the lack of a legislative framework specifically targeted to the internet, and the specificities of national regulatory “models” translate in different practices and can be a challenge for the states concerned. The Council of Europe commissioned a comparative study from the Swiss Institute of Comparative Law in respect of filtering, blocking and take-down of illegal content on the internet in the 47 member states of the Organisation. This study describes and assesses the legal framework but also the relevant case-law and practice in the field. The regulation of pornography has always been a contentious issue, which has sparked wide-ranging debates surrounding the acceptability and place of pornography in society. The use of the internet to distribute and access pornography has magnified this debate and has presented a number of challenges for the law in terms of effective and proportionate regulation. Following unsuccessful attempts by states to transpose traditional laws to cyberspace, a new and radical regulatory framework eventually evolved for regulating internet pornography. In this process, the focus of the law has changed from merely controlling the publication and distribution of obscene material to a model that aims to deter private consumption of illegal content. In addition, various self- and co-regulatory initiatives have been introduced with the involvement of non-state actors, imposing a certain degree of de facto liability on intermediaries, all of which raise interesting issues. This book examines the relevant regulatory responses to internet pornography, with particular reference to the UK, but also drawing comparisons with other countries where relevant. It argues that the internet has fundamentally, and in many ways irreversibly, changed the regulation of pornography. Classifying internet pornography into three broad categories – child pornography, extreme pornography, and adult pornography – the book provides an in-depth analysis of the legal issues involved in regulating internet pornography, and argues that the notions of obscenity and indecency on their own will not provide an adequate basis for regulating online pornography. The book identifies the legitimising factors that will lend credibility and normative force to the law in order to successfully regulate pornography in cyberspace. It is the only comprehensive text that rigorously addresses the regulation of internet pornography as a whole, and offers valuable insights that will appeal to academics, students, policy makers, and those working in the areas of broader internet governance and online child protection.

Specifically, the study addresses the question of what are the kinds of services that could invoke Article 14 ECD and develops an updated typology of hosting intermediaries for policy experts. It outlines the different potential revenue streams of different hosting intermediaries and discusses how these revenue streams may influence the incentives of services to address unlawful or infringing third-party activity. At the same time, panic-led policies must be avoided if the wider problems of child sexual abuse and commercial sexual exploitation are to be meaningfully addressed.
