Fazia falta entre nós um volume como este, capaz de dar conta da problemática dos signos visuais ou audiovisuais em toda sua extensão, profundidade, e variabilidade, ao mesmo tempo em que passa em revista as principais correntes teóricas que examinaram isso que chamamos de representação por imagens. No contexto das atividades práticas, críticas e acadêmicas, é muito comum ver como as imagens parecem resistir à análise e produzir toda sorte de discursos gaguejantes e desarticulados. Quem convive, como nós, em ambientes intelectuais que têm a imagem como matéria de investigação, já deve ter se acostumado à hegemonia daquilo que Lucien Sfez chamou, num outro contexto, de tautismo — contração de tautologia e autismo —, uma exótica modalidade retórica baseada no princípio do “repito, logo demonstro”. A dificuldade de submeter a imagem ao exame analítico e à investigação científica tem produzido, aliás, perigosas teorias sobre o inefável, ou sobre a suposta irredutibilidade das imagens ao discurso verbal, perigosas porque, em geral, servem de justificativa à letargia e à preguiça mental. Este livro de Santaella e Nöth chega no momento certo, para lançar um pouco de luz no terreno movediço das chamadas comunicações visuais. Ele reúne um conjunto de reflexões que funciona, ao mesmo tempo, como fundamentação teórica e instrumental analítico para uma abordagem séria das imagens, além de oferecer também todas as luzes necessárias para permitir discriminar entre as várias acepções, categorias e estados dos signos visuais. Claramente fundamentado nas ideias de Charles S. Peirce, o que lhe garante uma sistematização e uma coerência teórica raramente encontradas na bibliografia pertinente ao assunto, o livro abre-se também para a discussão de problemas filosóficos relevantes no plano do pensamento contemporâneo, como as questões da verdade, das representações internas (mentais), da mediação tecnológica, da intervenção das mídias na cultura atual, ou das intrincadas relações entre imagem e linguagem verbal. Agora, ninguém mais vai poder justificar atitudes de estupefação ou de impotência teórica diante de uma imagem, menos ainda repetir chavões surrados sobre uma suposta esterilidade conceitual da “civilização das imagens”. This volume addresses an important historiographical gap by assessing the respective contributions of tradition and foreign influences to the 19th century codification of criminal law. More specifically, it focuses on the extent of French influence – among others – in European and American civil law jurisdictions. In this regard, the book seeks to dispel a number of myths concerning the French model’s actual influence on European and Latin American criminal codes. The impact of the Napoleonic criminal code on other jurisdictions was real, but the scope and extent of its influence were significantly less than has sometimes been claimed. The overemphasis on French influence on other civil law jurisdictions is partly due to a fundamental assumption that modern criminal codes constituted a break with the past. The question as to whether they truly broke with the past or were merely a degree of reform touches on a difficult issue, namely, the dichotomy between tradition and foreign influences in the codification of criminal law. Scholarship has unfairly ignored this important subject, an oversight that this book remedies.
