Constitutional Personae written by Cass R. Sunstein and has been published by Oxford University Press this book supported file pdf, txt, epub, kindle and other format this book has been release on 2015-09-07 with Law categories.

Since America's founding, the U.S. Supreme Court had issued a vast number of decisions on a staggeringly wide variety of subjects. And hundreds of judges have occupied the bench. Yet as Cass R. Sunstein, the eminent legal scholar and bestselling co-author of Nudge, points out, almost every one of the Justices fits into a very small number of types regardless of ideology: the hero, the soldier, the minimalist, and the mute. Heroes are willing to invoke the Constitution to invalidate state laws, federal legislation, and prior Court decisions. They loudly embrace first principles and are prone to flair, employing dramatic language to fundamentally reshape the law. Soldiers, on the other hand, are skeptical of judicial power, and typically defer to decisions made by the political branches. Minimalists favor small steps and only incremental change. They worry that bold reversals of long-established traditions may be counterproductive, producing a backlash that only leads to another reversal. Mutes would rather say nothing at all about the big constitutional issues, and instead tend to decide cases on narrow grounds or keep controversial cases out of the Court altogether by denying standing. As Sunstein shows, many of the most important constitutional debates are in fact contests between the four Personae. Whether the issue involves slavery, gender equality, same-sex marriage, executive power, surveillance, or freedom of speech, debates have turned on choices made among the four Personae--choices that derive as much from psychology as constitutional theory. Sunstein himself defends a form of minimalism, arguing that it is the best approach in a self-governing society of free people. More broadly, he casts a genuinely novel light on longstanding disputes over the proper way to interpret the constitution, demonstrating that behind virtually every decision and beneath all of the abstract theory lurk the four Personae. By emphasizing the centrality of character types, Sunstein forces us to rethink everything we know about how the Supreme Court works.

Young People Sex And The Media written by D. Buckingham and has been published by Springer this book supported file pdf, txt, epub, kindle and other format this book has been release on 2003-12-05 with Social Science categories.

Are children today growing up too soon? How do they - and their parents - feel about media portrayals of sex and personal relationships? Are the media a corrupting influence, or a potentially positive and useful resource for young people? Drawing on an extensive research project, which investigated children's interpretations of sexual content in films, TV and print media, this book considers how young people (aged 9-17) use such material to understand their experiences and build their identities, and how they and their parents respond to public concerns about these issues. The book offers a clearly written and entertaining insight into children's and parents' perspectives on these difficult issues - perspectives that are often ignored or trivialised in public debate.

The Structural Crisis Of Capital written by Istvan Meszaros and has been published by NYU Press this book supported file pdf, txt, epub, kindle and other format this book has been release on 2010-03-01 with Philosophy categories.

In this collection of trenchant essays and interviews, István Mészáros, the world’s preeminent Marxist philosopher and winner of the 2008 Libertador Award for Critical Thought (the Bolivar Prize), lays bare the exploitative structure of modern capitalism. He argues with great power that the world’s economies are on a social and ecological precipice, and that unless we take decisive action to radically transform our societies we will find ourselves thrust headfirst into barbarism and environmental catastrophe. Mészáros, however, is no pessimist. He believes that the multiple crises of world capitalism will encourage the working class to demand center stage in the construction of a new system of production and distribution designed to meet human needs rather than serve the relentless pursuit of profit—a struggle which is already underway in places such as Venezuela. As John Bellamy Foster says in the foreword to this indispensable book, “Today the structural crisis of capital provides the historical setting for a new revolutionary movement for social emancipation in which developments normally taking centuries would flit by like phantoms in decades or even years. But the force for such necessary, vital change, remains with the people themselves, and rests on humanity’s willingness to constitute itself as both subject and object of history, through the collective struggle to create a just and sustainable world. This, Mészáros insists, constitutes the unprecedented challenge and burden of our historical time.”

A Constitution Of Many Minds written by Cass R. Sunstein and has been published by Princeton University Press this book supported file pdf, txt, epub, kindle and other format this book has been release on 2009-01-19 with Law categories.

The future of the U.S. Supreme Court hangs in the balance like never before. Will conservatives or liberals succeed in remaking the court in their own image? In A Constitution of Many Minds, acclaimed law scholar Cass Sunstein proposes a bold new way of interpreting the Constitution, one that respects the Constitution's text and history but also refuses to view the document as frozen in time. Exploring hot-button issues ranging from presidential power to same-sex relations to gun rights, Sunstein shows how the meaning of the Constitution is reestablished in every generation as new social commitments and ideas compel us to reassess our fundamental beliefs. He focuses on three approaches to the Constitution--traditionalism, which grounds the document's meaning in long-standing social practices, not necessarily in the views of the founding generation; populism, which insists that judges should respect contemporary public opinion; and cosmopolitanism, which looks at how foreign courts address constitutional questions, and which suggests that the meaning of the Constitution turns on what other nations do. Sunstein demonstrates that in all three contexts a "many minds" argument is at work--put simply, better decisions result when many points of view are considered. He makes sense of the intense debates surrounding these approaches, revealing their strengths and weaknesses, and sketches the contexts in which each provides a legitimate basis for interpreting the Constitution today. This book illuminates the underpinnings of constitutionalism itself, and shows that ours is indeed a Constitution, not of any particular generation, but of many minds.

Seasoned researchers and educators Gregory G. Colomb and Joseph M. Williams present an updated third edition of their classic handbook, whose first and second editions were written in collaboration with the late Wayne C. Booth. The Craft of Research explains how to build an argument that motivates readers to accept a claim; how to anticipate the reservations of readers and to respond to them appropriately; and how to create introductions and conclusions that answer that most demanding question, “So what?” The third edition includes an expanded discussion of the essential early stages of a research task: planning and drafting a paper. The authors have revised and fully updated their section on electronic research, emphasizing the need to distinguish between trustworthy sources (such as those found in libraries) and less reliable sources found with a quick Web search. A chapter on warrants has also been thoroughly reviewed to make this difficult subject easier for researchers Throughout, the authors have preserved the amiable tone, the reliable voice, and the sense of directness that have made this book indispensable for anyone undertaking a research project.
