Making, amending, and interpreting constitutions is a political game that can yield widespread suffering or secure a nation's liberty and prosperity. Given these high stakes, Robert Cooter argues that constitutional theory should trouble itself less with literary analysis and arguments over founders' intentions and focus much more on the real-world consequences of various constitutional provisions and choices. Pooling the best available theories from economics and political science, particularly those developed from game theory, Cooter's economic analysis of constitutions fundamentally recasts a field of growing interest and dramatic international importance. By uncovering the constitutional incentives that influence citizens, politicians, administrators, and judges, Cooter exposes fault lines in alternative forms of democracy: unitary versus federal states, deep administration versus many elections, parliamentary versus presidential systems, unicameral versus bicameral legislatures, common versus civil law, and liberty versus equality rights. Cooter applies an efficiency test to these alternatives, asking how far they satisfy the preferences of citizens for laws and public goods. To answer Cooter contrasts two types of democracy, which he defines as competitive government. The center of the political spectrum defeats the extremes in "median democracy," whereas representatives of all the citizens bargain over laws and public goods in "bargain democracy." Bargaining can realize all the gains from political trades, or bargaining can collapse into an unstable contest of redistribution. States plagued by instability and contests over redistribution should move towards median democracy by increasing transaction costs and reducing the power of the extremes. Specifically, promoting median versus bargain democracy involves promoting winner-take-all elections versus proportional representation, two parties versus multiple parties, referenda versus representative democracy, and special governments versus comprehensive governments. This innovative theory will have ramifications felt across national and disciplinary borders, and will be debated by a large audience, including the growing pool of economists interested in how law and politics shape economic policy, political scientists using game theory or specializing in constitutional law, and academic lawyers. The approach will also garner attention from students of political science, law, and economics, as well as policy makers working in and with new democracies where constitutions are being written and refined.

A study of the conditions of being a citizen, belonging and democracy in suburban Britain, this book focuses on understanding how a community takes on the social responsibility and pressures of being a good citizen through what they call ‘stupid’ events, festivals and parades. Building a community is perceived to be an important and necessary act to enable resilience against the perceived threats of neoliberal socio-economic life such as isolation, selfishness and loss of community. Citizenship, Democracy and Belonging in Suburban Britain explores how authoritative knowledge is developed, maintained and deployed by this group as they encounter other ‘social projects’, such as the local council planning committee or academic projects researching participation in urban planning. The activists, who call themselves the ‘Seething Villagers’, model their community activity on the mythical ancient village of Seething where moral tales of how to work together, love others and be a community are laid out in the Seething Tales. These tales include Seething ‘facts’ such as the fact that the ancient Mountain of Seething was destroyed by a giant. The assertion of fact is central to the mechanisms of play and the refusal of expertise at the heart of the Seething community. The book also stands as a reflexive critique on anthropological practice, as the author examines their role in mobilising knowledge and speaking on behalf of others. Citizenship, Democracy and Belonging in Suburban Britain is of interest to anthropologists, urban studies scholars, geographers and those interested in the notions of democracy, inclusion, citizenship and anthropological practice.

Crime, Shame and Reintegration is a contribution to general criminological theory. Its approach is as relevant to professional burglary as to episodic delinquency or white collar crime. Braithwaite argues that some societies have higher crime rates than others because of their different processes of shaming wrongdoing. Shaming can be counterproductive, making crime problems worse. But when shaming is done within a cultural context of respect for the offender, it can be an extraordinarily powerful, efficient and just form of social control. Braithwaite identifies the social conditions for such successful shaming. If his theory is right, radically different criminal justice policies are needed - a shift away from punitive social control toward greater emphasis on moralizing social control. Every day, small arms and light weapons (SALW) kill, wound, and threaten millions of adults and children. Due to their widespread availability, mobility, and ease of use, prolific SALW have become central to maintaining social dislocation, destabilization, insecurity, and crime in the build-up to war, during wartime, and in the aftermath of conflict. Small arms are misused within domestic settings, as well as in public spaces, affecting everyone in the community without regard to sex or age. The impact of these weapons can be vastly different for women and men and for girls and boys. However, careful consideration of gender and age is rare in the formulation of small arms policy, of planning small arms collection or control, or even in small arms research. To counter the effects of prolific SALW, their role in gender- and age-specific violence must be more deeply analyzed and the results applied at the policy and operational level. This work should be undertaken in war-afflicted contexts, in societies suffering from elevated levels of social violence and / or severe underdevelopment, and in those tolerant of the presence of individually owned firearms. Contributors to the book draw on experience and research from around the world on the nexus of gender, age, violence, and small arms in developing and developed countries. They provide a number of recommendations for policies, programs, and research designed to further illuminate and counteract the firing of the "sexed pistol."

Throughout the South Pacific, notions of ‘culture’ and ‘development’ are very much alive—in political debate, the media, sermons, and endless discussions amongst villagers and the urban élites, even in policy reports. Often the terms are counterposed, and development along with ‘economic rationality’, ‘good governance’ and ‘progress’ is set against culture or ‘custom’, ‘tradition’ and ‘identity’. The decay of custom and impoverishment of culture are often seen as wrought by development, while failures of development are haunted by the notion that they are due, somehow, to the darker, irrational influences of culture. The problem is to resolve the contradictions between them so as to achieve the greater good—access to material goods, welfare and amenities, ‘modern life’—without the sacrifice of the ‘traditional’ values and institutions that provide material security and sustain diverse social identities. Resolution is sought in this book by a number of leading writers from the South Pacific including Langi Kavaliku, Epeli Hau’ofa, Marshall Sahlins, Malama Meleisea, Joeli Veitayaki, and Tarcisius Tara Kabutaulaka. The volume is brought together for UNESCO by Antony Hooper, Professor Emeritus at the University of Auckland.
