La expedición del Código General del Proceso y el nuevo estatuto arbitral nacional e internacional generaron profundos cambios en la legislación procesal civil y el modelo de enjuiciamiento en Colombia. A partir de este contexto, Implicaciones procesales del Código General del Proceso en el Proceso Arbitral en Colombia estudia la naturaleza del proceso arbitral, analiza la aplicabilidad del Código General del Proceso al trámite especial y examina en detalle determinadas instituciones procesales, tales como la jurisdicción, la conciliación extrajudicial, la demanda, la integración de las partes, entre otras. En la mayoría de los Estados del mundo, el derecho procesal contiene como medio de defensa la generalidad de la impugnación y la especialidad de los recursos como parte integral del instituto de la impugnación para control general de las decisiones de los jueces que por alguna circunstancia se desvían del sendero propio de la pronta, cumplida y eficaz justicia al momento de proferir las providencias dentro de los procesos que vienen rituando por el ruego de quienes están insatisfechos con sus derechos constitucionales y legales1. En el procesalismo judicial, como lo advierte la jurisprudencia adoctrinada, estos medios de control son necesarios para poner fin al desvío de los principios de la autonomía e independencia de los jueces que, no obstante la presunción de buena fe respecto de su imparcialidad, se descuidan en la emisión de sus decisiones, y olvidan su deber de garantizar a la sociedad que jurídicamente son objetivas2, erguidas en el principio de un tratamiento igual para todas las personas y que solo se deben a la Constitución y a la ley, donde se inculca y asigna la tarea de protección efectiva de los derechos fundamentales, además de ser el punto de confluencia del derecho y la realidad, de cuya adecuada interrelación depende la justicia de una determinación.
