Land is a natural resource which has gained immense attention in recent years. Popularly used for the development of infrastructure, food production, farming, livestock, and other uses, this resource is vital for any country, let alone economy. While some countries boast vast amounts of water banks, others are land-locked, land abundant, and/or less utilised. This underutilisation and abundance has attracted financially capable investors from foreign countries with the hope of successfully purchasing and developing land for various projects. This trend has become common in less developed countries as they tend to have huge tracts of what is being termed available land. As a result, the rush for land has risen steeply due to an increase in land use. Land types differ but in most developing African countries, the most popular types are state and customary land. In some African countries like Zambia, the majority of the population dwells on customary land and depend on it for their livelihood. Land investments in Africa have sky rocketed over the years and while this may appear economically beneficial for some countries in need of economic growth, it has deceitfully resulted in some unpleasant outcomes, such as land grabs and improper land transactions. As a result, land tenure security has become a hot topic in developing countries due to this increase in improper land transactions taking place across the African continent and beyond and because, as a source of livelihood for rural communities, land is becoming scarce. To address this, a number of international organisations have been at work to assist countries with strategies, policies, or tools to improve their land governance and enhance tenure security. This study focuses on the application of such international standard tools in a local setting, particularly the Voluntary Guidelines on the Governance of Tenure (VGGT).

Every day millions of people around the world spend their hard-earned income improving houses they do not officially own or legally occupy. The vast majority are poor householders in urban areas of the South, where, in some cities, more than half the population lives in various types of unauthorized housing. As land in urban areas becomes more expensive and globalization accelerates the commercialization of urban land markets, people are forced to occupy unused government land, or purchase agricultural land and build a house without permission - activities that urban authorities are often seeking to prevent. Land, Rights and Innovation examines the complex issues surrounding land tenure, and the challenges they present for urban planners in the South and in the transition economies of Eastern Europe. Based on extensive research, the book brings together a diverse range of examples from 17 countries where the authorities, non-governmental organizations or communities have evolved practical, innovative approaches to providing tenure for the urban poor. Tenure insecurity has a variety of negative consequences for natural resource management, agricultural productivity, and poverty reduction, but the sources of tenure insecurity differ for men and women, and for individual, household, and collective lands. Research supported through PIM has helped advance policy reforms that improve access to, and tenure security of, land and natural resources and has supported more equitable and sustainable use of resources in less developed regions. Statutory recognition of customary rights, multistakeholder processes such as for land use planning, and organized social alliances such as Indigenous Peoples’ groups have emerged as important mechanisms for securing rights or enhancing access to collectively held lands. Long-term partnerships, ongoing engagement, and training for multiple actors at multiple scales increases the likelihood of successful implementation of tenure reforms. Further research on tenure security can contribute to achieving the Sustainable Development Goals, especially by clarifying how customary tenure can provide security and how tenure affects decision-making in multistakeholder platforms.

This book provides a significant contribution to the literature on land reform in various African contexts. While the economic evidence is clear that secure property rights are a necessary condition for catalysing broad-based economic development, the governance process by which those rights are secured is less clear. This book details the historical complexity of land rights and the importance of understanding this history in the process of trying to improve tenure security. Through a combination of single country case studies, comparative case studies and regional comparisons, the book is unequivocal that good governance is paramount for improving the performance of land reform programmes. All attempts at moving towards more formal secure tenure require congruence with informal norms, beliefs and values, and a set of clear systems and processes to avoid corruption and unintended negative consequences.

Tenure security is believed to be critical in spurring agricultural investment and productivity. Yet what improves or impedes tenure security is still poorly understood. Using household- and plot-level data from Ghana, this study analyzes the main factors associated with farmers’ perceived tenure security. Individually, farmers perceive greater tenure security on plots acquired via purchase or inheritance than on land allocated by traditional authorities. Collectively, however, perceived tenure security lessens in communities with more active land markets and economic vibrancy. Migrant households and women in polygamous households feel less secure about their tenure, while farmers with political connections are more confident about their tenure security.

Collaborative international research on tenure dates back at least to the early 1960s when the Land Tenure Centre was established at the University of Wisconsin-Madison and conducted some studies in collaboration with CGIAR social scientists. CGIAR interest in tenure increased in the early 1990s when natural resource management was strengthened as a component of the CGIAR agenda and the Centers on forests, agroforestry, and water (CIFOR, ICRAF, and IWMI) entered the system. CAPRi began to operate as a systemwide research program on tenure and collective action in the mid-1990s, and became PIM Flagship 5 on governance of natural resources in 2011. From 2021, a renewed research agenda on tenure is essential for advancing the One CGIAR mission of “science and innovation that advance transformation of food, land and water systems in a climate crisis.”

Within discussions of land and resource rights, there is growing attention to women’s rights, mostly in terms of household and individual rights to private property. This leaves unanswered questions about whether and how women’s land rights can be secured under collective tenure, upon which billions of people worldwide depend. There is an important gap in conceptual tools, empirical understanding, and policy recommendations on women’s land rights within collective tenure. To address this gap and lay the foundations for a sound body of empirical studies and appropriate policies, we develop a conceptual framework to improve understanding of women’s land rights under collective tenure. We begin by discussing what secure tenure for women on collective lands would entail. We then present the conceptual framework for what factors would affect women’s tenure security, building on a framework for land tenure security that focuses on individual and household tenure. We give attention to particularities of rangelands, forests, and other types of lands as well as commonalities across types of collective lands. A key theme that emerges is that for women to have secure tenure under collective tenure, two dimensions must be in place. First, the collective (group) itself must have tenure security. Second, the women must have secure rights within this collective. The latter requires us to consider the governance structures, how men and women access and control land, and the extent to which women have voice and power within the collective. More consistent analyses of collective tenure systems using the framework presented in this paper can help to identify which action resources are important for groups to secure rights to collective lands, and for women to advocate for their rights within the group.
