For indigenous cultures, property is an alien concept. Yet the market-driven industries of the developed world do not hesitate to exploit indigenous raw materials, from melodies to plants, using intellectual property law to justify their behaviour. Existing intellectual property law, for the most part, allows industries to use indigenous knowledge and resources without asking for consent and without sharing the benefits of such exploitation with the indigenous people themselves. It should surprise nobody that indigenous people object. Recognizing that the commercial exploitation of indigenous knowledge and resources takes place in the midst of a genuine and significant clash of cultures, the eight contributors to this important book explore ways in which intellectual property law can expand to accommodate the interests of indigenous people to their traditional knowledge, genetic resources, indigenous names and designations, and folklore. In so doing they touch upon such fundamental issues and concepts as the following: collective rights to the living heritage; relevant human rights norms; benefit-sharing in biological resources; farmers rights; the practical needs of documentation, assistance, and advice; the role of customary law; bioprospecting and biopiracy; and public domain. As a starting point toward mutual understanding and a common basis for communication between Western-style industries and indigenous communities, Indigenous Heritage and Intellectual Property is of immeasurable value. It offers not only an in-depth evaluation of the current legal situation under national, regional and international law including analyses of the Convention on Biological Diversity and other international instruments, as well as initiatives of the World Intellectual Property Organization (WIPO), the UN Food and Agriculture Organization (FAO), and other international bodies but also probes numerous further possibilities. This publication sets out to examine the major challenges for indigenous peoples to obtain adequate access to and utilization of quality health care services. It provides an important background to many of the health issues that indigenous peoples are currently facing. Improving indigenous peoples’ health remains a critical challenge for indigenous peoples, States and the United Nations. Indigenous peoples’ health status is severely affected by their living conditions, income levels, employment rates, access to safe water, sanitation, health services and food availability. They also face destruction to their lands, territories and resources, which are essential to their very survival. Other threats include climate change and environmental contamination. Geographical isolation and poverty results in not having the means to pay high cost for transport or treatment resulting in major structural barriers in accessing health care, further compounded by discrimination, racism and a lack of cultural understanding and sensitivity. Many health systems do not reflect the social and cultural practices and beliefs of indigenous peoples. At the same time, it is often difficult to obtain a global assessment of indigenous peoples’ health status because of the lack of data. More work is required in building existing data collection systems to include data on indigenous peoples and their communities.

In a world characterized by an encroaching homogeneity induced by the growth of multi-national corporations and globalization, the causes of difference accrue new levels of importance. This is as true of tourism as in many other spheres of life - and one cause of differentiation for tourism promotion is the culture of Indigenous Peoples. This offers opportunities for cultural renaissance, income generation and enhanced political empowerment, but equally there are possible costs of creating commodities out of aspects of life that previously possessed spiritual meaning. This book examines these issues from many different perspectives; from those of product design and enhancement; of the aspirations of various minority groupings; and the patterns of displacements that occur - displacements that are not simply spatial but also social and cultural. How can these changes be managed? Case studies and analysis is offered, derived from many parts of the globe including North America, Asia and Australasia. The contributors themselves have, in many instances, worked closely with groups and organizations of Indigenous Peoples and attempt to give voice to their concerns. The book is divided into various themes, each with a separate introduction and commentary. The themes are Visitor Experiences, Who manages Indigenous Cultural Tourism Product, Events and Artifacts, Conceptualisation and Aspiration. In a short final section the silences are noted - each silence representing a potential challenge for future research to build upon the notions and lessons reported in the book.
