Desde principios del siglo XX ha estado presente en el debate público el tema de la distribución de la tierra en Colombia. El intento de reforma agraria a mediados del siglo XX y los debates sobre su éxito o fracaso redistributivo, sin embargo, adquirieron otros significados con la emergencia de políticas rurales liberales en la década de los noventa, más preocupadas por la seguridad en la tenencia, la propiedad y la productividad de la tierra. Durante la segunda década del siglo XXI, con el crecimiento exponencial de grandes olas de desplazamiento forzado de poblaciones rurales a causa del conflicto armado (que habían empezado una década antes), el debate sobre la tierra revivió, con mucho énfasis en la importancia de los derechos de propiedad. A pesar de la proliferación de investigaciones so¬bre el papel que la tierra y su distribución desempeñan en la violencia en Colombia y de los múltiples diagnósticos de los efectos de dicha violencia sobre la población rural y sus derechos de propiedad, poner sobre la mesa la posibilidad de expedir la Ley de Víctimas y Restitución de Tierras hizo que el tema de la distribución volviera a alcanzar la dimensión de los debates originales de las reformas agrarias. Esta discusión cobró inusitada relevancia en el proceso de paz del Gobierno colombiano con la guerrilla de las FARC-EP. Con este contexto, Propiedad sobre la tierra en Colombia surge de las preocupaciones en medio de la transición a la paz con la guerrilla y une dos debates que, a pesar de estar estrechamente relacionados, suelen abordarse por separado en la literatura académica: las discusiones sobre la distribución de la tierra y las reformas agrarias, por un lado, y los debates sobre la propiedad desde la teoría del derecho, por otro.
