En este trabajo se presentan los principales resultados de los estudios nº 2701 y 2790 del CIS sobre «Calidad de la democracia». El objetivo de la investigación es analizar las opiniones de los ciudadanos españoles sobre el funcionamiento y calidad de su sistema democrático y descubrir los factores que se encuentran detrás de su evaluación. En primer lugar, el estudio analiza descriptivamente cómo juzgan los españoles el estado de la democracia y compara sus opiniones con las de los ciudadanos de cuatro comunidades autónomas para las que existen sobremuestras en la encuesta: Andalucía, Cataluña, Comunidad Valenciana y País Vasco. Los datos muestran que los españoles dan un suspenso al funcionamiento de la democracia, con una nota de 0,46 en una escala 0-1. Por comunidades autónomas, los ciudadanos del País Vasco, y en menor medida los de Cataluña, se muestran más críticos que el resto de españoles con la democracia, mientras que los de Andalucía y Valencia ofrecen valoraciones similares o por encima de la media nacional. En la parte analítica de la investigación se ponen a prueba dos hipótesis que miden la influencia de la situación económica y el rendimiento político institucional sobre las valoraciones de la democracia, en línea con una importante tradición teórica en la literatura que liga estas dos variables con el apoyo democrático. Si bien los resultados no son demasiado concluyentes, existen indicios de que ya en 2009, un año después del comienzo de la crisis económica en España, esta ejerció alguna influencia en las evaluaciones públicas de la calidad democrática.

For centuries, the Spanish state has proved to be an expert system for repressing political dissent and any threat that could jeopardize the maintenance of the status quo. It has done so using all the institutions and all the areas of power that were necessary, for the end has always justified the means. Carles Mundo, Catalan Minister of Justice, 2016-2017. There is no book in Spain that talks about lawfare. Nor is there a book that deals with the system of judicial repression of political dissidence deployed by the Franco regime. Nor is there a book that denounces the judicial system inherited from the dictatorial regime and that was later embodied in the 1978 Constitution. Lawfare (the combination of law and warfare) thus fills a void to the extent that it penetrates the authoritarian judicial system and highlights the democratic deficits of the Spanish judiciary. The politicization of justice began with the appointment, as president of the Constitutional Court, of a prominent member of the Peoples Party (Partido Popular PP) in 2013. Thereon started a process of judicialization of politics via reform of the Organic Law of the Court Constitutional. The referendums of November 9, 2014 and October 1, 2017 entailed the criminalization of the Catalan independence movement and a drastic reduction in fundamental rights linked to the exercise of political choice. This was confirmed by the judgment handed down by the Supreme Court in 2019, culminating in a lawfare strategy that has led to the criminal conviction of two presidents of the Generalitat Artur Mas and Joaquim Torra and the exile of a third president, Carles Puigdemont. Lawfare is the first book to link in a broad way the thinking of German jurists of the Nazi period to the training of judges in Spain both up to and during the Franco regime, and beyond. This volume considers corruption as a multidimensional, complex phenomenon in which various forms of corruption may overlap at any given time. Extending the seemingly paradoxical notion of “legal corruption” to such settings as the USA, Spain, and the Czech Republic, the book seeks to augment our understanding of corruption in democracies by focusing on conduct that is considered by large segments of the population to be corrupt even though they are not explicitly defined as such by the law or the governing elites. Such behaviors are not often captured by corruption perception indexes or identified by scholars who regard corruption as a single category—usually restricted to bribery. However, they are liable to incur a heavy price both in terms of trust in specific governments and of general system support. As illustrated by developments in Spain, the Czech Republic, and the corrosive presidential campaign of 2016 in the USA, these actions are liable to endanger both the quality and actual viability of democratic orders. This volume looks into the possibilities of legal reforms and anticorruption campaigns aiming to correct the consequences of such corruption on government legitimacy. A comparison between the anticorruption campaigns in the competitive authoritarian context of Russia and the fully authoritarian setting of China helps to identify both the difficulties and the possibilities of such efforts in democratic regimes.

The violent Basque separatist group ETA took shape in Franco's Spain, yet claimed the majority of its victims under democracy. For most Spaniards it became an aberration, a criminal and terrorist band whose persistence defied explanation. Others, mainly Basques (but only some Basques) understood ETA as the violent expression of a political conflict that remained the unfinished business of Spain's transition to democracy. Such differences hindered efforts to 'defeat' ETA's terrorism on the one hand and 'resolve the Basque conflict' on the other for more than three decades. Endgame for ETA offers a compelling account of the long path to ETA's declaration of a definitive end to its armed activity in October 2011. Its political surrogates remain as part of a resurgence of regional nationalism - in the Basque Country as in Catalonia - that is but one element of multiple crises confronting Spain. The Basque case has been cited as an ex- ample of the perils of 'talking to terrorists'. Drawing on extensive field research, Teresa Whitfield argues that while negotiations did not prosper, a form of 'virtual peacemaking' was an essential complement to robust police action and social condemnation. Together they helped to bring ETA's violence to an end and return its grievances to the channels of normal politics.
