In der vorliegenden Publikation wird das Thema der Werkstätten für behinderte Menschen vor dem Hintergrund der aktuell viel beachteten und diskutierten UN-Konvention für Behindertenrecht kritisch beleuchtet. Das Ausgangsinteresse ist, inwiefern die Werkstätten zukünftig noch rechtlich legitimierbar sind, da die UN-Konvention derartige stationäre Sondereinrichtungen eigentlich als nicht mehr zeitgemäß ansehen und abschaffen wird. Dies ist auch die Ausgangshypothese für die Studie. Um keine rechtliche Analyse zu machen, wird der Fokus auf etwas Konkreteres gelegt und der Aufbau der Werkstätten auf ihre soziale Bedeutung und ihre Funktion für die gesellschaftliche Inklusion geistig behinderter Menschen untersucht. Es wird die aktuelle Situation der Beschäftigung geistig behinderter Menschen in Werkstätten beleuchtet und dabei werden verschiedene Kritikpunkte herausgestellt. So sind die Werkstätten zum Beispiel nach wie vor die dominierende Form der Beschäftigung dieses Personenkreises und es mangelt an Alternativen, die dem heutigen Konzept der Inklusion entsprechen. Eigentlich müsste mehr dafür getan werden, die Beschäftigung in einem inklusiven Umfeld zu fördern, da die Werkstätten ihrer eigentlichen Aufgabe - der Förderung des Übergangs auf den allgemeinen Arbeitsmarkt - nur ungenügend nachkommen und die jährlichen Übergangsquoten erschreckend gering ausfallen. Nach der Darlegung der aktuellen Situation wird das Recht auf Arbeit nach der UN-Konvention für Behindertenrecht kritisch untersucht. Dabei wird insbesondere den § 27 der Konvention in Bezug auf Werkstätten kritisch hinterfragt und versucht, einen vorsichtigen Ausblick auf die mögliche, kommende Entwicklung zu geben. Auch hier werden diverse Kritikpunkte herausgearbeitet, sowohl bei der Formulierung der UN-Paragraphen als auch bei der geplanten Umsetzung, und ein vorsichtiger Ausblick auf die kommende Entwicklung gegeben.
