This book addresses the disparity between positive non-treaty law and its scholarly assessment in the area of moral concepts, understood as altruistic as opposed to reciprocal legal obligations. It shows how scholars are generously willing to assert the existence of a rule of international law, thereby moving further away from actual state practice, not taking into account the factors of legal rhetoric and the core survival interests of the state in the formation of custom and general principles of law. The main argument is that such moral concepts can simply not manifest themselves as non-treaty sources of international law from a dogmatic perspective. The reason is the inherent connection between the formation of the non-treaty sources of international law and state interest that makes it difficult, if not impossible, to assess state practice or opinio juris in the case of altruistic obligations. The book further demonstrates this finding by looking at two cases in point: Human rights and humanitarian exceptions to the prohibition of force. As opposed to the majority of existing works on the subject, State Interest and the Sources of International Law takes a bigger-picture approach to a number of distinct problems in international law scholarship by looking at the building blocks of international relations on the one hand, and merging this with sources doctrine on the other. This book re-examines the law governing the obligations of the Member States in the European Union from the perspective of the interests formulated and pursued by national governments in the EU. Member States’ interests provide the source as well as the limitations of the obligations undertaken by the Member States in the Union. It has become a commonplace assumption in modern political debate that white and rural working- and middle-class citizens in the United States who have been rallied by Republicans in the “culture wars” to vote Republican have been voting “against their interests.” But what, exactly, are these “interests” that these voters are supposed to have been voting against? It reveals a lot about the role of the notion of interest in political debate today to realize that these “interests” are taken for granted to be the narrowly self-regarding, primarily economic “interests” of the individual. Exposing and contesting this view of interests, Dean Mathiowetz finds in the language of interest an already potent critique of neoliberal political, theoretical, and methodological imperatives—and shows how such a critique has long been active in the term’s rich history. Through an innovative historical investigation of the language of interest, Mathiowetz shows that appeals to interest are always politically contestable claims about “who” somebody is—and a provocation to action on behalf of that “who.” Appeals to Interest exposes the theoretical and political costs of our widespread denial of this crucial role of interest-talk in the constitution of political identity, in political theory and social science alike.

How do states know what they want? Asking how interests are defined and how changes in them are accommodated, Martha Finnemore shows the fruitfulness of a constructivist approach to international politics. She draws on insights from sociological institutionalism to develop a systemic approach to state interests and state behavior by investigating an international structure not of power but of meaning and social value. An understanding of what states want, she argues, requires insight into the international social structure of which they are a part. States are embedded in dense networks of transnational and international social relations that shape their perceptions and their preferences in consistent ways. Finnemore focuses on international organizations as one important component of social structure and investigates the ways in which they redefine state preferences. She details three examples in different issue areas. In state structure, she discusses UNESCO and the changing international organization of science. In security, she analyzes the role of the Red Cross and the acceptance of the Geneva Convention rules of war. Finally, she focuses on the World Bank and explores the changing definitions of development in the Third World. Each case shows how international organizations socialize states to accept new political goals and new social values in ways that have lasting impact on the conduct of war, the workings of the international political economy, and the structure of states themselves.
