This book offers a comprehensive, article-by-article legal commentary on the United Nations Convention Against Transnational Organized Crime and its Protocols on trafficking in persons, smuggling of migrants, and trafficking in firearms and ammunition. The Convention- often referred to by the acronym UNTOC- was approved by the UN General Assembly on 15 November 2000 and made available for governments to sign at a high-level conference in Palermo, the heartland of the Italian Mafia, on 12-15 December 2000. For this reason, UNTOC is sometimes also referred to as the 'Palermo Convention'. The Convention entered into force on 29 September 2003. The purpose of UNTOC is to promote cooperation to prevent and combat transnational organized crime more effectively. UNTOC seeks to promote consistency among national legal systems and set standards for domestic laws so that States parties can effectively combat transnational organized crime. UNTOC is supplemented by three protocols: the Protocol against the Smuggling of Migrants by Land, Air, and Sea, the Protocol to Prevent, Suppress, and Punish Trafficking in Persons, especially Women and Children, and the Protocol against the Illicit Manufacturing of and Trafficking in Firearms, their Parts and Components, and Ammunition. Article by article, this books presents the text of each provision of the Convention and the Protocols, followed by a systematic analysis of their background and negotiating history, their interpretation by the Conference of the Parties and its working groups, in judicial decisions by domestic and international courts, , in the academic literature, and in official material published by international organisations, chief among them the United Nations Office on Drugs and Crime (UNODC), the guardian of UNTOC and the Protocols. Louise Frechette: ARUNA 2005/2006 edition Ms Louise Frechette is Distinguished Fellow at the Centre for International Governance Innovation, Waterloo, Ontario. Ms Frechette's introduction to ARUNA 2005/2006 covered "United Nations reform: an unfinished story". As the first Deputy Secretary-General of the UN, Ms Frechette was uniquely positioned to undertake a personal assessment of what has changed and what has not changed in the past decade at the UN and why. She examined if the UN is functioning better than it was 15 years ago, why reform is so difficult to achieve and what the future holds for the institutions. Rubens Ricupero: ARUNA 2004/2005 edition Mr Rubens Ricupero is Dean of the Fundacno Armando Alvares Penteado (FAAP), Sao Paulo and was formerly Secretary-General of UN Conference on Trade and Development (UNCTAD) and Minister of Finance of Brazil. Mr Ricupero's introduction to ARUNA 2004/2005 covered "The difficulty of building consensus in an age of extremes" and examined the mysteries of the negotiating process leading to the outcome of the 2005 World Summit. Rather than a "Grand Bargain" of a comprehensive UN reformin the areas of development, security and human rights, it is argued that the Summit ended more on a note of lamentation and regret over a missed opportunity. Mr Ricupero concludes that contrary to the daring proclamation at the outset by the Secretary-General, the conditions indispensable to succeed were not in place. Indeed, it was hard to imagine that an ambitious and balanced reform package for the UN could have had any real chance of succeeding.

Even though impacts generated by the widespread availability and ongoing use of small arms and light weapons have not reached a magnitude sufficient to radically reorder contemporary world affairs, awareness of the nature and extent of these impacts has compelled some international actors to take decisive action. Damien Rogers examines how the international community has responded to the challenge of controlling small arms and light weapons since the early 1990s. Using a postinternationalist analytic framework, he specifically focuses on the maturing relationships between particular actors of world affairs and the nascent interconnectivity between their strategies for, and approaches toward, controlling these weapons. This book, based on field research in the West African country of The Gambia, explores how domestic gun control is shaped by international efforts and how local actors interact with international organizations or opt not to do so. The book also shows how the question of who can have what kind of gun under what circumstances is an intrinsic question to modern societies across the world, but it is seldom one that is addressed in sub-Saharan Africa except in cases of post-conflict countries. Small arms control and gun control are often treated as separate efforts, with the former the domain of international actors such as the United Nations and the latter being of concern to the domestic politics of countries such as the United States. By focusing on a country that has never seen the outbreak of a civil war, the book is able to disentangle the complex roots of gun control in Africa, its origins in colonial era legislation, its reverberations across social life, and how it shapes contemporary understandings of groups ranging for security guards to hunters.

Although it receives much less attention than better known disarmament processes, the destruction of small arms is reshaping the military arsenals of the world. Out of roughly 200 modern military small arms world-wide, about 500,000 are destroyed every year. The commitment of major governments and international organizations makes small arms destruction is a permanent addition to the global disarmament repertoire. But the prospects for greater military small arms disarmament may be declining, as war in Afghanistan and Iraq create unprecedented demand for second-hand weaponry. Inconspicuous disarmament of small arms and ammunition is reshaping the global picture of firearms, light weapons and ammunition. The process is far from comprehensive, but much more than cosmetic. Small arms destruction is here to stay, but its contributions may be fleeting. This book is the first full-length examination of the issue. The defining moments of 2001, the terrorist attacks of September 11 against the UnitedStatesofAmerica, markedaturningpointininternational lawandrelations. Bytheirscaleandaudaciousness, overnighttheyhelpedtopropeltheissueofint- national terrorism to the top of the international security agenda and particularly that of the USA, with consequences for many branches of international law, including the jus ad bellum, the jus in bello, international law relating to terrorism, international human rights law and international criminal law, that were just beginning to be felt as the year closed. The September 11 attacks were immediately characterised by the United States 3 as an act of war, an armed attack on such ascale asto constitute an armed conflict. Its immediate response was to declare a so-called 'Global War on Terrorism'. Avowedly acting in self-defense, on 7 October the US launched armed attacks against Afghanistan, notbecause Afghanistan wasconsidered tobelegally resp- sible for the September 11 attacks but for harbouring and refusing to surrender members of Al Qaeda, including its leader, Osama Bin Laden, and refusing to dismantle terrorist training camps. Although the main target of the attacks was Al Qaeda, the armed conflict that ensued was an international armed conflict between the US and its allies and the state of Afghanistan, notwithstanding that the US never recognised the Taleban as the government of Afghanistan.
