Although there is no denial of climate justice, there has been a persistent lack of practical joined-up actions regarding the creation of an international climate institution. However, politicians and academic researchers have been working together to find solutions. This new book is an attempt to put forward constructive approaches to climate security and justice, building upon the inputs from the wide-ranging debates that took place at the CASS Forum on Climate Justice and the Carbon Budget Approach in Beijing (April 2010). The purpose of this prestigious international conference was to construct an international climate regime and to help promote climate justice. It also called on governments, particularly governments in developed countries, to bear the historical responsibility of climate change. Climate change is a controversial topic worldwide today and the international regime and corresponding actions will inevitably have a lasting and profound influence on the world economy and international politics. At its thirteenth session, held in Bali, Indonesia, at the end of 2007, the Conference of the Parties to the United Nations Framework Convention on Climate Change (UNFCCC) adopted the Bali Action Plan, initiating a new process of negotiations on long-term cooperative actions under the Convention with the goal of reaching international agreements on an international climate regime beyond 2012 at the fifteenth session of the Conference to be held in Copenhagen, Denmark, at the end of 2009. The key factors in the present international climate negotiations are a shared vision of global long-term cooperative actions, mitigation, adaptation, technology and finance, and their core issue is how to reach an agreement for equitable burden-sharing of obligations for the reduction of greenhouse gas emissions or allocation of emission entitlements in accordance with the concrete conditions of various countries and to ensure the implementation of such an agreement under an appropriate international regime. As the largest developing country in the world, China plays an important role in international climate negotiations and is under increasing international pressure.The existing Kyoto Protocol model takes the level of emissions in 1990 as a base and determines the emission reduction obligations of each developed country through negotiation. The findings gathered together in this book break through the fixed pattern of thinking of the Kyoto Protocol and, based on the theory and methodology of the basic carbon emissions needed for human development, studies a carbon budget proposal for global greenhouse gas emission reductions. This proposal not only better embodies the principle of "e;common but differentiated responsibilities"e; established by the Climate Convention, but will also be able to realize global goals for mid- and long-term emission reductions. It represents a comprehensive proposal for developing a more equitable and more effective international climate regime.The CASS Forum on Climate Justice and the Carbon Budget Approach in Beijing (April 2010) was organised in association with the Institute for Urban and Environmental Studies of the Chinese Academy of Social Sciences, Konrad Adenauer Foundation and Misereor.

Climate change is one of the major environmental concern of many countries in the world. Negotiations to control potential climate changes have been taking place, from Rio to Kyoto, for the last five years. There is a widespread consciousness that the risk of incurring in relevant economic and environmental losses due to climate change is high. Scientific analyses have become more and more precise on the likely impacts of climate change. According to the Second Assessment Report of the Intergovernmental Panel on Climate Change, current trends in greenhouse gases (GHGs) emissions may indeed cause the average global temperature to increase by 1-3. 5 °C over the next 100 years. As a result, sea levels are expected to rise by 15 to 95 em and climate zones to shift towards the poles by 150 to 550 km in mid latitudes. In order to mitigate the adverse effects of climate change, the IPCC report concludes that a stabilization of atmospheric concentration of carbon dioxide - one of the major GHGs - at 550 parts per million by volume (ppmv) is recommended. This would imply a reduction of global emissions of about 50 per cent with respect to current levels. In this context, countries are negotiating to achieve a world-wide agreement on GHGs emissions control in order to stabilize climate changes. Despite the agreement on targets achieved in Kyoto, many issues still remain unresolved.

Furthermore they have realized that this will lead to more natural catastrophes, than have already occurred. The scope of the present assignment is to point out what the international climate politics for reducing the human-based greenhouse effect and what is the status quo of emission reduction measures are. Therefore chapter one highlights the fundamentals of the greenhouse effect and which gases trigger it. Especially the carbon dioxide emissions lead to an increased warming of the earth with an amount of 9-26 per cent. The main cause for the greenhouse effect with approximately 50 per cent is the burning of fossil energy sources like petrol or wood. Chapter two characterizes the development of international climate politics. Beginning in the year 1979 at the first world climate summit a worldwide binding climate protection was first passed in December 1997 when the United Nations established a protocol at the Nations Conference in Kyoto which has the aim to "stabilize the amount of greenhouse gas concentrations in the atmosphere at a level that would prevent dangerous anthropogenic interference with the climate system"1. The protocol establishes legally binding commitments for the reduction of greenhouse gases. So far 183 states have ratified the protocol. Furthermore three different Kyoto Mechanisms will be explained, that are to help to achieve the agreed climate goals. One of these mechanisms is Emission Trading that is used on the one hand on national level within the Kyoto Protocol and on the other hand on company level. A solution to the problem of climate change requires close international cooperation and difficult reforms involving all states. Law has a clear role to play in that solution. What is not so clear is the role that law has played to date as a constraining factor on state conduct. International Climate Change Law and State Compliance is an unprecedented treatment of the nature of climate change law and the compliance of states with that law. The book argues that the international climate change regime, in the twenty or so years it has been in existence, has developed certain normative rules of law, binding on states. State conduct under these rules is characterized by generally high compliance in areas where equity is not a major concern. There is, by contrast, low compliance in matters requiring a burden-sharing agreement among states to reduce global greenhouse gas emissions to a ‘safe’ level. The book argues that the substantive climate law presently in place must be further developed, through normative rules that bind states individually to top-down mitigation commitments. While a solution to the problem of climate change must take this form, the law’s development in this direction is likely to be hesitant and slow. The book is aimed at scholars and graduate students in environmental law, international law, and international relations.
