The reactivation of the Security Council at the beginning of the last decade has resulted, since the invasion of Kuwait by Iraq on August 2, l990, in increasing use of its powers under Chapter VII of the Charter and the adoption of measures against a number of state and non-state entities. The notion of a threat to the peace has now come to encompass violations of fundamental norms of international law such as human rights and humanitarian law, and the wide-ranging measures adopted have included such innovations as the establishment of the UN Compensation Commission or that of the two international criminal tribunals for Former Yugoslavia and Rwanda. These measures have not only infringed on the legal rights of the targeted state (sometimes with irreversible effects where they have remained in force over a long period of time) and its population, but also on those of implementing states and of private rights within these states. The current debate over the legitimacy and long-term effects of economic sanctions on states and their populations makes it imperative to re-evaluate this instrument and the broader peace maintenance function of the Security Council in the light of current community concerns. Part One of this book addresses the theoretical issues by focussing on: 1) The place of sanctions in the international legal system; 2) the limits to the powers of the Security Council and the question of accountability; and 3) an assessment of the alternatives to collective economic sanctions. Part Two looks at the relationship between sanctions and humanitarian issues, examining the relationship between: 1) Sanctions and human rights law; 2) sanctions, humanitarian issues and mandates; and 3) sanctions and humanitarian law. Part Three focuses on implementation by states of Security Council sanctions resolutions by examining: 1) Sanctions and private rights; and 2) special problems for implementing states. Part Four addresses the future in reassessing the place and ethics of sanctions in an international legal system which is giving increased importance to the individual. This work is based on papers presented at a colloquium of the Graduate Institute of International Studies in Geneva.

The demise of the former Yugoslavia was brought about by various secessionist movements seeking international recognition of statehood. This book provides a critical analysis from an international law perspective of the break-up of Yugoslavia. Although international recognition was granted to the former Yugoslav republics of Slovenia, Croatia, Bosnia-Hercegovina and Macedonia, the claims of secessionist movements that sought a revision of existing internal federal borders were rejected. The basis upon which the post-secession international borders were accepted in international law involved novel applications of international law principles of self-determination of peoples and uti possidetis. This book traces the developments of these principles, and the historical development of Yugoslavia's internal borders.

The errors - military, political, and not least diplomatic - in the continuing unfolding of the Yugoslav tragedy over the decade since the Fall of the Berlin Wall and the final ending of the Cold War, offer certain lessons. It had been confidently predicted that the complex, multi-national Yugoslav state created by the World War I victors at Versailles in 1919, and continued by the post-World War II peace settlements, would not long survive Marshal Tito's death. As it happened, when the moment of truth arrived the concert of Western European powers had no clear and coherent plans ready for a rational brokering of the resulting problems of State Succession, including renewed federal or confederal structures, and peaceful and orderly transfer and relocation of civil populations if fragmentation and independence were to be the immediate policy options. The rush to a 'premature' State Recognition by one or more leading Western European political players, without having any congress of Berlin-style game-plan ready to guide and direct this, may have triggered the on-rush of political and military events that led, in quick succession, to the Bosnian and then the Kosovo tragedies of the 1990s. The author, currently President of the Institut de Droit International and a jurisconsult and advisor, over the years, to international and national governmental authorities, examines consequences and challenges for International Law and Law-making, as we enter the new Millennium. Taking note of the antinomies and contradictions inherent in Classical International Law Categories like Territorial Integrity and the Self-determination of Peoples, the Non-Use-of-Force and Collective (regional) Self-Defence, the author considers, in particular, the direct conflict, in the case of both Bosnia and Kosovo, between the United Nations Charter principle of Non-Intervention and the claimed 'New' International Law principle of Humanitarian Intervention. The legally permissible modalities and structures and processes for exercise of Humanitarian Intervention, in accord with the United Nations Charter and also general International Law, are canvassed and weighed.
