Noch nie in der Geschichte der Zivilisation war das Überqueren geopolitischer Grenzen so leicht und schnell. Grenzenlosigkeit des Cyberspace und Begrenztheit des nationalen Strafanwendungsraums stellen ein Dilemma für alle dar, die Lösungen für die strafrechtliche Zuständigkeit im Cyberspace benötigen. Durch die vergleichende Analyse der Rechtslage in Deutschland, Russland und den USA mit integrierter Falllösung kommt die Autorin zu folgendem Ergebnis: Die nationalen Alleingänge sind in der Lösung des Problems der strafrechtlichen „Allzuständigkeit“ im Cyberspace zum Scheitern verurteilt. Alleinig ist eine internationale Lösung denkbar. Absehbar ist, dass sich ohne die Schaffung international anerkannter Zuständigkeitsregelungen bzw. entsprechender internationaler Institutionen, etwa eines Internationalen Cybercrime Gerichtshofs, eine zunehmend extensive extraterritoriale Anwendung nationalen Strafrechts zur Quelle zwischenstaatlicher Spannungen entwickelt.

Cybergrooming, die Anbahnung des sexuellen Missbrauchs eines Kindes über Soziale Medien und Onlinespiele, gilt als eines der schwerwiegendsten digitalen Risiken für Kinder. Für viele Kinder gehört es dabei zur Normalität in einer digitalisierten Welt aufzuwachsen und ihre Zeit in Sozialen Medien und Onlinespielen zu verbringen. In diesen Programmen spielen und kommunizieren die Kinder ganz selbstverständlich auch mit unbekannten Erwachsenen und anderen Minderjährigen. Hieraus können für die Kinder eine Vielzahl von Risiken entstehen. Eines der vermutlich relevantesten ist dabei die Gefahr, dass das Kind Opfer eines Sexualdelikts wird. Wie effektiv sind aber gegenwärtig die gesellschaftlichen und vor allem kriminalpolitischen Maßnahmen, um Kinder vor solchen Risiken in einem globalisierten digitalen Raum zu schützen? Dieses Buch setzt sich daher grundlegend mit dem Phänomen des Cybergroomings und seiner gesellschaftlichen Bekämpfungsstrategien auseinander. Neben einer umfangreichen Darstellung der Phänomenologie, der Täter- und Opferstruktur sowie der Ursachen für normenabweichendes Verhalten im digitalen Raum aus Sicht der Cyberkriminologie, liegt ein Schwerpunkt der Arbeit auf der strafrechtlichen Einordnung von Cybergrooming in Deutschland.
