Die Begrifflichkeit "selektiv", die soviel bedeutet wie "auf Auswahl beruhend" macht deutlich, dass das selektive Vertriebssystem seiner Natur nach auf einen begrenzten Absatzmarkt gerichtet ist, während der Vertrieb über das Internet auf die Masse abzielt. Dieses Spannungsverhältnis findet sich bereits in der Aufnahme von Vertriebsbeschränkungen in vertikalen Vereinbarungen wieder und sollte eigentlich durch eindeutige Regelungen in der novellierten Vertikal-GVO (Mai 2010), an der solche Vertriebsbeschränkungen zu messen sind, aufgelöst werden.

The Federal Republic of Germany passed a law to combat VAT fraud in international ecommerce. The new legislation is described and discussed. Ecommerce sellers will have to provide their tax registration and a certificate issued by the competent tax authority that shows their VAT compliance to platform operators. Otherwise platform operators are liable for VAT evasion of the respective ecommerce sellers. Without providing a tax registration and the certificate platform operators will not allow sellers to sell on their platforms anymore. The transition period will be much shorter for overseas sellers than for EU sellers. Practical problems will arise at the beginning likely. Suspension of accounts can be the consequence.

Retail is ‘going digital,’ and grocery shopping is no exception. While some businesses are relaying on their corporate website to make the sale, both traditional brick-and-mortar and new disruptive business models are increasingly using online marketplaces to offer their products online. European Union law has been gradually updated to reflect this new reality, with Intellectual Property Rights legislation and Consumer Law leading the way toward a suitable regulatory framework in the Platform Economy. However, the EU has not devised a comprehensive strategy for tackling the challenges posed by the online sale of physical consumer goods, such as effective public enforcement in online environments. In fact, sector-specific legislation, including Food Law, largely ignores online transactions. In this context, the book evaluates the impact that online marketplaces are having on European Union sector-specific legislation and its e-nforcement. The goal is to assess whether the existing regulatory and policy framework are sufficient for promoting compliance and bridging the enforcement gap in the digital single market.
