What are the functions of competition authorities and courts: the control of market results or safeguarding the competitive process? Whose interests are protected by the law against private restraints on competition? What significance can be attributed to economics in competition law and to what extent are economic approaches compatible with the ruling law? The author deals with these and other questions and attempts to find answers from an epistemological, an economic, a legal and a philosophic perspective. German description: Im Zuge des so genannten more economic approach sind in letzter Zeit in der EU Meinungen geaussert und Vorschriften erlassen worden, die dazu fuhren konnten, dass inskunftig Wettbewerbsbeschrankungen zunehmend unter dem Gesichtspunkt der wirtschaftlichen Effizienz betrachtet werden. Mit diesem Ansatz werden wirtschaftliche Verhaltensweisen von Unternehmen nicht mehr danach beurteilt, wie sie die Handlungs- bzw. Wettbewerbsfreiheit beschranken, sondern danach, ob diese im Ergebnis die wirtschaftliche Wohlfahrt befordern oder aber vermindern. Grundfrage der vorliegenden Untersuchung ist, ob okonomische Effizienz ein fur das Wettbewerbsrecht attraktives rechtspolitisches Ziel darstellt. Da die neue Wettbewerbspolitik das Gemeinwohl befordern will, untersucht Adrian Kunzler unter Bezugnahme auf den klassischen Utilitarismus zunachst das okonomische Verhaltenskonzept und thematisiert den okonomischen Wohlfahrtsbegriff. Anschliessend geht er der Frage nach, ob wirtschaftliche Wohlfahrt ein Entscheidungskriterium darstellt, das fur die Beurteilung konkreter Falle bei der Rechtsanwendung brauchbar ist. Unter Berucksichtigung der zur Zeit einschlagigen wissenschaftstheoretischen Erkenntnisse zeigt er, dass Wettbewerbskonzeptionen axiomatischen Charakter haben. Ausgehend von der Auffassung, dass okonomische Wettbewerbskonzeptionen nicht beweisbar wahr oder falsch sind, sondern dass es sich um blosse Entwurfe und nichts Definitives handelt, untersucht der Autor schliesslich, ob und inwieweit die neue Wettbewerbspolitik mit den derzeit geltenden kartellrechtlichen Regeln, insbesondere derjenigen der EU vereinbar ist.Das Werk wurde mit dem Issekutz-Preis 2008 der Rechtswissenschaftlichen Fakultat der Universitat Zurich fur hervorragende Leistungen im Bereich des Wirtschaftsrechts ausgezeichnet.

This study offers a systematic analysis of basic questions relating to equitable income taxation. Of course, a definite solution, resting on scientific arguments, cannot be expected for this important field of government activity. However, what is possible, is an exhaustive dis cussion of various aspects of equitable income taxation, thus preparing the ground for reasonable political decisions. I hope that the present book will contribute to this continuing discus sion, presenting results from modern social-choice theory and optimum taxation theory in order to gain further insights into the problem of income taxation. On a fundamental level, social-choice theory is applied in order to in vestigate the normative foundation of different tax rules. Arrow's im possibility theorem forms the starting point of the analysis; as was shown by recent contributions to social-choice theory, this impossibi lity result can be overcome if various degrees of interpersonal utility comparisons are admitted. Using this approach, one can work out the general norms of equity behind familiar tax rules. As a special point, the traditional principle of equal proportional sacrifice will be given a social-choice theoretic foundation in this book. The second level on which tax rules can be discussed, concerns their respective consequences in concrete taxation models. TWo such models are specified in this study, the first one takes gross income of the taxpayers as given, it is contrasted with the second, more complex mod el, where the individual labour-leisure decision is taken into account.

THE CONCEPTION OF THIS VOLUME This volume, Cardinalism, has been initiated by Ole Hagen, and is now published due to his perseverance and to Kluwer Academic Publishers. Because of various activities and duties, my contribution to the general conception of this volume has only been formal, and all the credit for it is due to Ole Hagen. I should also emphasize that the responsibility for the year's delay in the publishing of this volume is entirely mine, for two reasons. First of all, I have been involved in many works in very different fields. Second, the English translation of my 1943 contribution to the concept of cardinal utility took some time. The points of view the reader will find in this volume are often different and sometimes contradictory, but this can only increase the interest of its reading. In any case, this is not the editors' part to side with or against. Thus contributions to this volume are presented as they have been submit ted to the editors. This book grew out of the conviction that the preparation and management of large-scale technological projects can be substantially improved. We have witnessed the often unhappy course of societal and political decision making concerning projects such as hazardous chemical installations, novel types of electric power plant or storage sites for solid wastes. This has led us to believe that probabilistic risk analysis, technical reliability analysis and environm,ental impact analysis are necessary but insufficient for making acceptable, and justifiable, social decisions about such projects. There is more to socio-technical decision making than applying acceptance rules based on neglige ably low accident probabilities or on maximum credible accidents. Consideration must also be given to psychological, social and political issues and methods of decision making. Our conviction initially gave rise to an international experts' workshop titled 'Social decision methodology for technological projects' (SDMTP) and held in May 1986 at the University of Groningen, the Netherlands, at a time when Cvetkovich spent a sabbatical there. The work shop - aimed at surveying the issues and listing the methods to address them - was the first part of an effort whose second part was directed at the production of this volume. Plans called for the book to deal systematically with the main problems of socio-technical decision making; it was to list a number of useful approaches and methods; and it was to present a number of integrative conclusions and recommendations for both policy makers and methodologists.
