Situar la interpretación en el quehacer jurídico supone deslindar los campos: I) La interpretación, en cuanto resultado de la acción de interpretar, es una de las tres formas epistémicas que el lenguaje nos permite. Las otras dos son la compresión y el conocimiento. II) Interpretar es una acción o actividad que se lleva a cabo a partir de la comprensión y, en ese sentido, se hace sobre algún aspecto de la realidad. III) Solo se requiere interpretar cuando es necesario jugar un juego de lenguaje. Luego, tomando prestado el concepto de "juegos de lenguaje" de Wittgenstein. sostenemos que la interpretación no se da en todos los niveles del lenguaje sino solo en aquellos casos en los que un sujeto, no satisfecho con lo que comprende en el ámbito ordinario, intenta asignar o construir un sentido que resulte pertinente de cara al juego de lenguaje que está jugando, como es el caso del Derecho.

Este libro tiene tres objetivos complementarios; primero, reiterar brevemente las premisas filosóficas de la hermenéutica contemporánea y la aportación de nuestra época a la tradición crítica que empieza con Juan Luís Vives (s. XVI), recibe un impulso de Giambattista Vico (s. XVII), de Wilhelm von Humboldt (s. XVIII) y con la obra de F.E.D. Schleiermacher se impone una dirección nueva de interpretación cultural. Aunque la hermenéutica del s. XIX es dominada por Wilhelm Dilthey y su concepto de las ciencias humanas, es en el s. XX que la hermenéutica filosófica ha tenido su mayor desenvolvimiento, empezando con Heidegger, Gadamer, Habermas y Ricoeur. La tradición hermenéutica de Vives a Ricoeur es uno de los grandes movimientos intelectuales a través de más de cuatro siglos. El segundo objetivo es examinar la ontología del texto literario en relación con la ontología del texto crítico y, al emprender esta deliberación dialéctica, examinar también la relación de Derrida con Ricoeur en cuanto a premisas compartidas y diferencias profundas. El tercer, y último, propósito de este libro es demostrar las consecuencias de estas observaciones filosóficas en la crítica literaria. En breve, este libro propone que la interpretación literaria es una comunicación de la experiencia estética, es decir, la crítica literaria es básicamente una celebración de la creación estética. Se comentan textos de Borges y Paz.

Este trabajo se inicia a partir de la constatación de un hecho: la paulatina desaparición del concepto "verdad" del léxico científico y filosófico y su reemplazo por el de "interpretación". Si bien su evidencia más notoria se advierte en la praxis lingüística, ésta va acompañada de una profunda transformación en todos los ámbitos de la vida, especialmente en las creencias y convicciones de los seres humanos de las postrimerías del siglo XX e inicios del siglo XXI. En ese tránsito hay una figura de capital importancia, la del filósofo germano Federico Nietzsche. Aunque su pensamiento no es la causa remota del fenómeno, que viene andando desde hace mucho en la historia de Occidente, es quien primero lo percibe con absoluta nitidez y lo anuncia por doquier con insistente perseverancia en su abundante y magnífica obra, cuya síntesis extrema la constituye la expresión "Dios ha muerto".
