ABSTRACT: This study investigated legal implications of differential disciplinary treatment of special education and non-special education students in K-12 public schools. It focused on interpreting and applying federal and state education legislation by courts and how various judicial decisions affect discipline practices in public school systems, asking if preferential treatment was afforded to students with disabilities through implementation and interpretation of educational legislation. The historical myriad of complex legislation passed before and after inception of Public Law 94-142 in 1975 was studied, exploring relationships between school discipline of children who do and do not receive special education services. Research included review of pertinent books, journal articles, published and unpublished papers, and personal communications with experts in education and law. It identified appellate court cases dealing with school discipline and compared rulings. Law and education authorities were interviewed. Surveys were developed and administered to discern teachers' understanding of educational legislation. It attempted to formulate a theory addressing consistencies and inconsistencies associated with public school discipline, along with reinforcement of that treatment by the United States court system, offering implications and recommendations for practice and for further research. Emphasizing data collection from primary and secondary documents, this study took a historical perspective. Conclusions indicate that school compliance is directly tied to financial mandates and that school-based personnel have little discretionary power disciplining students with disabilities. School officials are caught between attempts to keep schools safe and complying with federal and state mandates to avoid forfeiting allocated funds. Many teachers feel unsafe at schools attributing that feeling to inability to control students' classroom behavior. Inabilities stem from inequities in consequences for discipline infractions by students with and without disabilities, inequities that have court precedents. Implications are that, based on the number of cases filed on behalf of students without disabilities, parents are seeking similar rights for their children as those of children with disabilities. Numbers indicate cases involving students with disabilities are resolved at lower levels of due process. Inequities are advocated by issuing various mandates and funding/compliance guidelines serving to strip local school districts of their ability to maintain and self-regulate schools.

What do constitutional interpretation and legal education have in common? For one thing, they share the same tension between theory and practice, between form and substance, between process and outcomes, between constancy and change, and between local and comparative perspectives. Each also has a substratum of fundamental underlying values that demand, but do not always receive, clear articulation. For another thing, they have both been the subject of illuminating examination by Michael Coper over the course of a long and distinguished career. An extraordinary group of authors, including Justice Stephen Gageler, the Hon Michael Kirby and Sir Anthony Mason, come together in this book to celebrate Coper's achievement, and take his various contributions as a jumping off point for their own further scholarly insights. From the gripping story of the revolution that swept away the old law on section 92 of the Constitution, to the endemic conflict in the judicial process between legalism and realism, to the never-ending controversy about the Dismissal, to perceiving the world and organising legal knowledge in new ways through biography and oral history, to the role of educators in shaping the views and values of newcomers to this knowledge, this book contains over a dozen sparkling essays by some of Australia's most renowned and respected lawyers, as well as a substantial reflective commentary by Michael Coper himself. An intellectual feast!

This book offers educational experiences, including reflections and the resulting essays, from the Roberta Kevelson Seminar on Law and Semiotics held during 2008 – 2011 at Penn State University’s Dickinson School of Law. The texts address educational aspects of law that require attention and that also are issues in traditional jurisprudence and legal theory. The book introduces education in legal semiotics as it evolves in a legal curriculum. Specific semiotic concepts, such as “sign”, “symbol” or “legal language,” demonstrate how a lawyer’s professionally important tasks of name-giving and meaning-giving are seldom completely understood by lawyers or laypeople. These concepts require analyses of considerable depth to understand the expressiveness of these legal names and meanings, and to understand how lawyers can “say the law,” or urge such a saying correctly and effectively in the context of a natural language that is understandable to all of us. The book brings together the structure of the Seminar, its foundational philosophical problems, the specifics of legal history, and the semiotics of the legal system with specific themes such as gender, family law, and business law.

Special Education Law, Sixth Edition, written by Laura Rothstein and Scott F. Johnson, provides a comprehensive and current overview of the major federal law, and judicial interpretations of those laws, that apply to special education students. School administrators and attorneys attend to special education issues on a regular basis, and local superintendents, principals, special education professionals, psychologists, and regional and state administrators must also be familiar with the legal requirements of educating students with disabilities. Classroom teachers in all types of classrooms need to be aware of the laws that affect them and their students. Special Education Law 6e is intended for students in education and educational administration, both graduate and undergraduate, as well as law students in courses on special education law, school law, and special education. The framework of this book begins with five introductory chapters on the major issues that are addressed in special education law. These topics include an overview the legal system, the history of special education, major statutes in special education law, stakeholders such as students, families, educators, and advocates, and finally, requirements for protection under various special education laws. The remainder of the text presents and analyzes special education case law within specific contexts. The text helps educators understand what the law requires so that they can make decisions that comply with these laws. Updates for the sixth edition include a major reorganization of the text. Chapters have been streamlined and edited for clarity, combining a previous chapter on Related Services with Free Appropriate Publication Education, and folding Eligibility into Identification, Evaluation, and Eligibility, so students can better see the connections between these topics. Many case excerpts have been shortened or summarized to provide students with a more straightforward and focused reading experience. The latest updates in statutes, regulations, and case law are included throughout the text.
