In questo volume si analizzano alcuni problemi fondamentali legati alla formazione del giudizio nell’ambito del processo. Partendo dalla ‘rilettura’ di opere e autori di estrazione eterogenea (non solo giuristi), si è cercato di costruire un’epistemologia giudiziaria adeguata agli attuali contesti, caratterizzati da una crescente permeabilità extra-ordinamentale e da un’incontenibile mobilità giurisprudenziale. L’attenzione prevalente al dato argomentativo e logico-linguistico ha spinto l’autore ad abbozzare una teoria normativa del ragionamento giudiziale di natura retorica, con qualche distinguo di rilievo rispetto alle esistenti formulazioni neoretoriche, neodialettiche ed interpretativistiche. La proposta che prende corpo gradualmente nella successione dei capitoli è orientata verso una forma di sillogismo giudiziale di tipo ‘cooperativo’, nel quale siano valorizzati argomentativamente i discorsi di tutti i soggetti processuali: non solo del giudice, dunque, ma in particolare anche degli avvocati. Per questo motivo, nella conclusione si esprimono alcune considerazioni deontologiche sulla professione forense, che si vorrebbe più saldamente legata ad una seria educazione metodologica.
